Rolf Groeschner

Rolf Gröschner (* 4. December 1947 in Nuremberg ) is a German lawyer and university professor in retirement ; he was the drummer for the band Improved Sound Limited .

Career

After graduating from high school in Nuremberg in 1967, Gröschner studied business administration at the Universities of Erlangen-Nuremberg and Munich . He completed his studies with a degree in business administration . Then Gröschner studied law , also in Erlangen-Nuremberg and Munich, and completed his studies with the first state examination in law . This was followed in 1981 with a doctorate with the thesis "Dialogik und Jurisprudenz: The Philosophy of Dialogue as Philosophy of Legal Practice" , 1985 the second state examination in law . In 1990 , Gröschner completed his habilitation with the thesis “The legal surveillance relationship: economic surveillance in the tradition of commercial police law and change in economic and administrative law”. After Visiting Professor in Wuerzburg and Muenster In 1991 he received a call to Mainz . In 1993 he was appointed to the Friedrich Schiller University in Jena , where he was full professor of the chair for public law and legal philosophy until the end of the 2012/2013 winter semester . From 1998 to 2000 he was dean of his faculty and in 2009 and 2010 he was a fellow at the Max Weber College for Cultural and Social Studies in Erfurt . From 2004 to 2013 he was chairman of the Hellmuth-Loening-Zentrum für Staatswissenschaften Jena eV, from 2010 to 2018 board member of the German section of the International Association for Legal and Social Philosophy (IVR) and from 2013 to 2018 member of the advisory board of the Roman Herzog Institute (RHI) .

Gröschner was the drummer in the band Improved Sound Limited, which was particularly successful from the mid-1960s to the mid-1970s. She also accompanied Roy Black for a time and wrote the music for "Ezra Pound", "The 6th Day", " Play School ", " The Commissioner ", "Krempoli", "The Baker's Bread" and "In the Course of Time “(By Wim Wenders ).

Gröschner is married and has two daughters.

Research priorities

Three focal points of his scientific life's work were honored in a commemorative publication on his 70th birthday: “Republic - Legal Relations - Legal Culture”. Philosophical, dogmatic and methodological basic work by Gröschner on legal culture are gathered in the volume "Dialogik des Rechts". His website "Freiheitsdialog" offers "Philosophical conversations about true and false friends of freedom" with videos, audios and texts.

Day of remembrance

In 2010, Gröschner demanded that November 9 be included in the federal state holiday laws as the “day of remembrance” , as this day, due to its history, was more suitable for the National Socialist past , but above all for the revolutions of 1918 and 1989 to remember, which were essential for the democratic development of Germany . He justified this demand u. a. in the volume "Days of Revolution - Feste der Nation", which was published together with Wolfgang Reinhard , and promoted them in the Thuringian state parliament .

Spelling reform

Gröschner first became known to the public for his negative position on the spelling reform .

For a long time, opponents of the spelling reform tried to a. to prevent by legal means. Gröschner has played a leading role in this since 1995. His resistance to the spelling reform led to headlines and reports in domestic and foreign media for decades.

Unconstitutionality of the spelling reform

At Gröschner at the University of Jena, Wolfgang Kopke was working on a doctoral thesis, which was published in December 1995 under the title “Spelling Reform and Constitutional Law - Aspects of a Reform of German Orthography under School Law, Personal Law and Cultural Constitutional Law”. In December 1996 this work was named one of the “Legal Books of the Year” by a number of well-known law professors.

In his essay "Spelling reform on the decree?" Of September 15, 1995, a short version of the most important thoughts of his dissertation, Wolfgang Kopke took the position that it would be a violation of fundamental rights if the spelling reform were to be heard over the heads of the population and the representatives of the people want to enforce.

Constitutional complaint May 1996

In May 1996, Gröschner lodged a constitutional complaint against the planned spelling reform at the Federal Constitutional Court in Karlsruhe . It was not admitted by the judges with the argument that the spelling reform had not yet been introduced in Bavarian schools.

Friedrich Denk's lawsuit at the Munich Administrative Court

After it was introduced in Bavaria, the grammar school teacher Friedrich Denk sued the administrative court in Munich against the spelling reform. The complaint was written by Gröschner. The two opponents of the reform argued that the parliament had been passed over as legislature and that there was therefore no legal basis for the introduction of the spelling reform. As the father of a daughter of school age and as a teacher, Denk is doubly affected.

Gernot Holstein against the spelling reform

In Berlin, Gröschner advised the plaintiff Gernot Holstein and was also successful. The tangible success of a leap revision to the Federal Administrative Court in Berlin was prevented by a constitutional complaint before the Federal Constitutional Court.

In 1998, Gröschner acted as legal representative in the proceedings of the lawyer couple Thomas Elsner and lawyer Gunda Diercks-Elsner from Lübeck with lawyer Thomas Schüller before the Federal Constitutional Court against the reform.

The decision of the Federal Constitutional Court was announced on July 14, 1998. The constitutional judges allowed the introduction of the spelling reform in schools through ministerial edicts. The fundamental rights of parents and students would not be violated.
