District court Aurich
The district court Aurich is one of five district courts in the district of the district court Aurich . It is based in Aurich in Lower Saxony .
Responsibilities
The judicial district includes the cities of Aurich and Wiesmoor and the communities of Großefehn , Ihlow and Südbrookmerland . Since 1999 the Aurich District Court has acted as an insolvency court for the East Frisian districts of Aurich , Emden , Wittmund and Norden . Since 2005 the register matters of the regional court district Aurich have been transferred to the district court Aurich. The Aurich Regional Court is superior to it. The competent higher regional court is the higher regional court in Oldenburg .
The District Court of Aurich is responsible in particular for the following proceedings under ordinary jurisdiction:
Advisory assistance matters
Care and guardianship matters
including adoption and foster care matters
Family matters
inter alia matrimonial matters (divorces and annulment of the marriage), other family matters (parental custody, maintenance suits, contact regulations, child matters, pension adjustment, marital home and household effects, property law)
Land register matters
including registration of changes of ownership or land charges
Deposit matters
Bankruptcy matters
Regular and consumer bankruptcies for the district court districts of Aurich, Emden, Norden and Wittmund
Agricultural matters
Reminders
only old procedures; Since September 1, 2005, reminders have been filed at the Uelzen District Court - Central Dunning Court
Estate matters
among other things, safekeeping and opening of wills, issuing of inheritance certificates
Register matters
including all entries in the commercial register, register of cooperatives, property law and associations for the Aurich regional court district; the partnership register has been kept centrally at the Hanover District Court since August 1, 2005.
Criminal and fine matters
Among other things, individual judicial orders, penalty warrant procedures, criminal proceedings before the (juvenile) criminal judge, (juvenile, extended) lay judges' court, fine proceedings
Civil litigation
including civil proceedings up to a value in dispute of EUR 5000, rental disputes
Foreclosure matters
including foreclosures, administrative matters, attachment and transfer orders, other enforcement matters
history
Up until the end of the East Frisian Princely House in 1744, there were four courts in Aurich: the court court, the chancellery court, the district court and the city court. The district court was responsible for the residents of the Aurich office.
After the revolution of 1848 was the Kingdom of Hanover , the jurisdiction of the administration separated and the patrimonial abolished. The district court was then founded with the ordinance of August 7, 1852 regarding the formation of the district courts and lower administrative authorities as a royal Hanover district court. It comprised the office of Aurich , the office of Timmel and the city of Aurich. The district court was subordinate to the Aurich Higher Court . With the annexation of Hanover by Prussia , it became a Prussian district court in the province of Hanover .
Courthouse
The courthouse is located in the Aurich city park. The main house was built in 1713, and the north wing was opened in 1885. In 1953 another side wing followed. The top floors were expanded in 1996. The branch of the district court was dissolved in 1997. Another extension followed for the management of the authorities and administration. In 2005 the basement was renovated.
