Daniel Krause (lawyer)

Daniel Krause (born July 2, 1964 in Berlin ) is a German lawyer . He mainly works as a criminal defense lawyer in white- collar crime .

Life

Krause comes from a family of lawyers, his mother and grandfather were lawyers, while his father was a pastor . Krause grew up in Berlin and studied law at the Universities of Bonn , Freiburg , and Columbia University in New York . In 1995 he did his doctorate under Urs Kindhäuser on a subject of white-collar crime and has been a lawyer in Berlin ever since.

Krause is a member of the Criminal Law Committee of the Federal Bar Association , co-editor of the New Journal for Criminal Law (NStZ) published by CHBeck Verlag and author of the commentary on the Code of Criminal Procedure (Löwe / Rosenberg ), justified by Ewald Löwe .

Krause achieved fame through his appearance in various high-profile economic criminal proceedings. Among other things, he represented Klaus Esser in the Mannesmann trial before the Düsseldorf Regional Court . He also represented Wolfgang Vogel , Herbert Grönemeyer , Stefan Krause , Markus Frick and Manfred Schmidt . In the corruption case to Ferrostaal he defended the CEO, Matthias Mitscherlich. Matthias Graf von Krockow , former member of the management of the Sal. Oppenheim & Cie. , defended Krause in various criminal proceedings concerning the bank. Krause represented the German Football Association in connection with the public prosecutor's investigations into the award of the 2006 World Cup in Germany . In the so-called Böhmermann affair , Krause defended the moderator Jan Böhmermann in the criminal proceedings against a satirical poem and the like, which were initiated as a result of the criminal complaint by Turkish Prime Minister Recep Tayyip Erdoğan . a. on suspicion of insulting organs and representatives of foreign states according to § 103 StGB old version. The proceedings were discontinued. Krause defended the main shareholder of Volkswagen AG , Porsche SE , before the Stuttgart Regional Court in the proceedings regarding allegations of incorrect information to the capital market as part of the failed takeover attempt of the Volkswagen Group by Porsche. The trial ended in an acquittal.

In connection with legal advice on so-called cum-ex transactions , he represents the international law firm Freshfields Bruckhaus Deringer , including in the parliamentary committee of inquiry of the German Bundestag and in connection with investigations by the Frankfurt Public Prosecutor's Office .

Currently (2018), Krause represents the interests of Volkswagen AG and other companies of the VW Group in the so-called diesel affair in connection with various public prosecutor's investigations conducted in Germany and in numerous other countries.

Krause runs a law firm specializing in commercial and tax criminal law in Berlin, which currently (2018) employs eleven lawyers.
