The Vienna Commercial Court (HG Wien) is a special court established in the Austrian capital Vienna specializing in corporate law . In addition to the decision on certain corporate and insolvency law issues in the district of the Regional Court for Civil Law Matters , the Commercial Court of Vienna also has special jurisdiction for Austria-wide decisions on certain issues such as trademark and design protection law, patent law and non-labor lawsuits against the Austrian National Bank . The Vienna Commercial Court has had its seat since 2003 on the 12th to 24th floors of the Justice Center in Vienna-Mitte .
Jurisdiction
In principle, the commercial senates or single judges at the regional courts are responsible for decisions on commercial court matters in accordance with Section 51 of the jurisdiction norm. Only Vienna has its own commercial court, which is responsible for deciding on these issues in accordance with paragraph 3. For example, the Vienna Commercial Court acts as the commercial register court for Vienna. The Vienna Commercial Court acts as an appeal instance for the District Court for Commercial Matters Vienna , which is also a district court with special jurisdiction for commercial matters.
In addition to the corporate law issues in the court district of Vienna, which in particular include disputes from company-related transactions (para. 1 no. 1), the Vienna Commercial Court has further special responsibilities. For example, the court is responsible for all utility model, semiconductor, trademark, design, patent and plant variety protection law in Austria and thus covers a large part of intellectual property law cases (apart from copyright).
Another special responsibility is the assignment of insolvency law matters in the district of the Regional Court for Civil Law Matters Vienna to the Commercial Court Vienna in Section 64 of the Insolvency Code , whereby the HG Vienna becomes the insolvency court for Vienna. In addition, the HG Wien is also responsible throughout Austria for lawsuits against the Austrian National Bank (unless they are related to labor law matters), for court-related matters under the ORF Act and for representative actions against changes in premiums under the Insurance Contract Act.
