Homosexuality is legal in San Marino , but the state has not yet recognized same-sex couples.

The total ban on homosexuality was abolished in San Marino in 1865. In 1974, however, the Parliament of San Marino passed a new penal code, which came into force in 1975 and, in Section 274, made homosexual acts as a criminal offense for causing public nuisance. However, there are no reports that Section 274 was ever applied. In 2004, Section 274 of the Criminal Code was repealed by Law No. 121 of September 23, 2004.

The age of consent , as in Italy, set uniformly at 14 years.

Anti-discrimination laws

Anti-discrimination protection for sexual orientation has existed in the constitution since June 2019 . In November 2018, the protection of sexual orientation was discussed beforehand in parliament.

Recognition of same-sex couples

San Marino has legally recognized same-sex partnerships nationwide through the introduction of Registered Partnerships since November 2018. Since 2016, various bills have been submitted to parliament for advice, which are intended to enable a civil partnership institute for same-sex couples. In November 2018, the Parliament of San Marino endorsed the introduction of civil partnerships for homosexual couples and enabled stepchild adoption for partnered couples.
