In terms of homosexuality, Romania isa more socially conservative Eastern European country. Still, homosexuality is becoming increasingly accepted in some major cities.

Homosexuality was legalized in the private sector in 1996. It was not until 2001 that a decision by the European Court of Human Rights repealed Article 200 of the Romanian Criminal Code, which punished public manifestations of homosexuality. Homosexuality is equal to heterosexuality in the age of consent and the age of consent was adjusted to 15 years in 2002.

Anti-discrimination laws

An Anti-Discrimination Act has existed at the legal level since 2000, prohibiting discrimination on the basis of sexual orientation in the areas of employment, education, property, health care and access to goods and services. The law was issued as an implementation of the anti-discrimination legislation of the European Union . Homosexual people can serve in the army.

Recognition of same-sex partnerships

In Romania, same-sex marriage and registered partnership are not legally allowed. The state has not yet officially recognized same-sex couples. In March 2014, a bill to introduce a registered partnership in Romania failed. The “Coalition for the Family”, an alliance of 23 organizations supported by the Romanian Orthodox Church, collected around 3 million votes from January 2016 to June 2016 to call for a referendum , which is supposed to prohibit same-sex marriage in the constitution . In March 2018, the Social Democratic party leader Liviu Dragnea announced that the ruling Social Democrats in Romania want to enable a civil partnership institute for homosexual couples.
