Institute for European Media Law

The Institute for European Media Law (EMR) eV is a media law specialist institute in the field of broadcast , multimedia , telecommunications and competition law , based in Saarbrücken . It aims to present the requirements of European media law for the German regulations and at the same time to participate in the further development of the media order at European level. The institute serves to deal with topics and to safeguard interests for private broadcasters, public broadcasters , state supervisory bodies or commercial participants in media law and media technology market events.

history

The association was founded on August 10, 1990 in Saarbrücken . The founding director was the legal advisor of Saarländischer Rundfunk (SR), Dieter Dörr . In addition, the director of Saarland Broadcasting, Manfred Buchwald , and the head of the Saarland State Chancellery , attorney Reinhold Kopp , were significantly involved in the establishment of the company. Other founding members were lawyer Klaus Hümmerich, member of the KEF, Norbert Holzer , mayor and board member of the State Agency for Broadcasting (LAR) (today State Media Authority Saarland ), Alfons Lauer , media officer in the State Chancellery of Saarland, Steffen Müller, personal assistant to the director of the SR and Head of International Relations, Willi Gehrlein, lawyer at SR, Eberhard Jost, managing director of Telefilm Saar GmbH, lawyer and managing director of APR, Stephan Ory , and Petra Wolf, legal advisor of LAR. On September 1, 1992, the institute opened a liaison office in Brussels.

Since 1994 the institute has been a partner of the European Audiovisual Observatory (EAI) in Strasbourg , of which the majority of the member states of the Council of Europe and the European Commission (for the European Union ) are members. In this year, the development of the database "European Media Information System" (EMIS) began, a collection of currently around 2300 legal texts from Europe . Since 1998, the institute has been in charge of the online database “German Media Information System” (DEMIS) on behalf of the German state media authorities. DEMIS contains more than 2000 decisions of German and European courts and administrative authorities, some of which are otherwise unpublished. In order to be able to market this information potential, these databases were integrated into EMR Consulting & IT Systems GmbH.

In 1997 the institute founded a research advisory board which supports the institute in the scientific development of new subject areas and in the dogmatic underpinning of expert knowledge. The advisory board is made up of personalities from media studies and practice. Since May 2008 the EMR has had a liaison office in Berlin with Kopp as a representative. At the end of 2010, the institute celebrated its 20th anniversary with a festive ceremony in Berlin. The speakers were u. a. the President of the Court of Justice of the European Court of Justice , Vassilios Skouris , and the Prime Minister of the Saarland, Peter Müller .

Institute

The activities cover the topics of broadcasting and telecommunications law as well as related areas of law such as copyright , press , film and data protection law. In addition to these topics, the institute also deals with aspects of the legal development of the new media, for example e-commerce and e-government , as well as the principles of open access to transmission and distribution platforms for media content and, in general, competition and antitrust law .

For the purposes of cooperation with the EAI and the preparation of comparative law studies, the institute has built up an international network of correspondents, the “EMR Media Network”, since the mid-1990s. This consists of around 180 national media law experts from 40 European countries who support the institute in obtaining and processing information.

The EMR is also a partner of the German state media authorities and the EAI. Another cooperation partner is the Saarland University with the law faculty and the legal branch of the Europa-Institut . The institute also maintains partnerships with the Hans Bredow Institute at the University of Hamburg , the Institute for Information Law at the University of Amsterdam and the Media Law and Policy Center in Moscow . Members of the board of the EMR also hold lectureships at the Saarland University and the Mainz Media Institute .

The aim of the association is to make a contribution to the development of media law and policy as an information and communication platform . Since its inception, the EMR has held conferences, workshops , panels and discussions with experts.

Areas of activity

The institute sees itself as a service provider for:

  • the implementation of Europe-wide events on media law issues;
  • the preparation of legal opinions and scientific elaborations for public and private clients on current media law issues, the current research results are regularly published under EMR-Impulse;
  • the preparation of publications that are published in the EMR series, the institute's own newsletter , the IRIS newsletter, the IRIS plus, the IRIS Spezial, the specialist journal MultiMedia und Recht and in specialist journals, books and commentaries;
  • Advice in the media sector in Europe , in particular in cooperation with the Council of Europe , the European Parliament , the European Commission , the Committee of the Regions , the parliamentary groups in Germany , private and public broadcasters from Germany and abroad, the state media authorities and foreign media supervisory authorities , State governments, as well as associations and foundations ;

organization

The current business is carried out by the board of directors, currently consisting of the director, lawyer Stephan Ory and the scientific director Mark D. Cole, as well as the executive board member Jörg Ukrow.

The organs of the association are the general assembly and the board of directors elected by it (chairman of the board is currently Stephan Ory).

The sponsoring association consists of full and sustaining members, a total of approx. 70 people and 15 institutions. The full members are usually academics and practitioners from the media sector, the supporting members are primarily recruited from private and public broadcasters in Germany and abroad as well as the state media authorities.

In addition, there is a research advisory board that accompanies the association in scientific matters.

The EMR employs several people who are qualified to be judges , an assistant and legal staff.

Publications

The EMR is the publisher of its own publication series with currently more than 40 volumes, in which conferences are documented, reports and research results are published, and dissertations and commemorative publications are published. In addition, the results of the EMR activities are published in the third-party publications mentioned above (in the areas of activity ).
