Accidental death

Junior Malanda was killed in a traffic accident on Autobahn 2 near Porta Westfalica in North Rhine-Westphalia . He was only 20 years old. According to witnesses, the VW Touareg , in which Malanda was riding, skid in heavy rain and hit a tree. Malanda sat in the back seat, was thrown out of the car and died on the scene. According to the Bielefeld police, Malanda was not wearing a seat belt. The driver of the vehicle, Anthony D'Alberto (youngster of RSC Anderlecht ), and the co-driver Jordan Atheba (former youngster of KSV Roeselare ) were seriously injured. As it became known in the days after his death, the police registered 21 speeding violations in the accident vehicle that belonged to Malanda in the six months before Malanda's death, including ten violations of over 200 km / h. His manager Peter Smeets said that Malanda almost never drove any of these violations.

Malanda was buried on January 20, 2015 in Sint-Agatha-Berchem . The funeral service took place in the National Basilica of the Sacred Heart .

The main hearing against the driver of the accident vehicle Anthony D'Alberto took place after several months of delays on July 4, 2016 before the lay judge of the district court of Minden . The defendant D'Alberto was accused by the Bielefeld public prosecutor's office of having contributed to the death of Malanda by exceeding the speed on a wet road. The public prosecutor's office accused him of negligent homicide in accordance with Section 222 of the Criminal Code .

The process was still at the trial in return for cash circulation amounting to 4,000 € according §153a Code of Criminal Procedure set .

In the proceedings it turned out that D'Alberto with a driven 95-120 km / h clearly exceeded the speed limit of 80 km / h, but so did Malanda, since he unbuckled his seat belt to look for a charging cable for his cell phone in the footwell bears a certain complicity. In addition, the 80 km / h limit only began 120 m before the accident site. Due to the fact that the defendant only had his driver's license for seven months at the time of the accident, the court assumes a driving error.

Despite the expert opinion, it could not be determined with complete certainty whether Malanda would have survived if he had been buckled up in the accident.
