As Nuxit called German media since at least the end of 2016 to mid 2017 specifically targeted exit of the district town of Neu-Ulm in the Bavarian district of Neu-Ulm . The Bavarian Ministry of the Interior rejected the application on June 4, 2019.

Before Freising and Dachau, the city ​​of Neu-Ulm is by far the largest municipality in Bavaria in terms of inhabitants. With 57,237 inhabitants as of December 31, 2015, Neu-Ulm clearly exceeds the minimum size of 50,000 inhabitants required by the current Bavarian municipal code for a new urban district. Neu-Ulm was already free of a district until it was incorporated into the Illerkreis (district of Neu-Ulm since May 1, 1973: District of Neu-Ulm) as part of the regional reform in Bavaria on January 1, 1971, with effect from July 1, 1972.

Nuxit is an art and portmanteau , a fusion of NU (the license plate number of Neu-Ulm, but also of the district) and exit ( German  exit ). This word formation was based on the terms Brexit for the exit of the United Kingdom from the European Union and Grexit for a possible exit of Greece from the euro zone .

Exit procedure

Since the regional reform of 1972, no Bavarian city has decided to leave the district. On July 26, 2017, the Neu-Ulm City Council decided with a clear majority of 37 to 7 votes to work out a motion for the district town to leave the Neu-Ulm district. The approval of the Bavarian State Government and the Bavarian State Parliament is required for an exit .

According to the population as of December 31, 2015, Neu-Ulm, as an independent city, would by no means be the smallest of the 26 independent cities in Bavaria in terms of population, but would be in 15th place. The district of Neu-Ulm, which is currently in eleventh place among the 71 districts, would be in 48th place without the city of Neu-Ulm. According to the Bavarian municipal code, however, the decisive criterion is the financial capacity of the district, which must be maintained.

The district administrator of the Neu-Ulm district, Thorsten Freudenberger , announced after the Neu-Ulm city council decision on July 26, 2017, that in the Nuxit case, the district office would be relocated from the city of Neu-Ulm, possibly to Senden or Illertissen . After the Nuxit, Senden would be the largest city in the (remaining) district, followed by Illertissen, which was the seat of what was then the district of Illertissen until the district reform in 1972 and currently houses a branch of the Neu-Ulm district office. In 1972, the old district of Illertissen was largely merged with the Illerkreis and a smaller part in the south in the new district of Unterallgäu .

On March 21, 2018, the Neu-Ulm city council commissioned the city administration with 32 to 10 votes to apply to the Bavarian state government for district freedom.

With the approval of the Bavarian State Parliament, the exit would not have taken effect before mid-2020.

On June 4, 2019, the Bavarian Ministry of the Interior rejected the application in a press release on the grounds that overriding reasons of public welfare speak against the removal. According to the Ministry of the Interior, the application lacks sufficiently specific concepts as to who and how municipal tasks should be carried out in the future. In addition, the property law relationships between the city and the Neu-Ulm district are unclear. In particular, there is no agreement on the three high-deficit hospitals, without which no reliable statements can be made about the financial effects of a district freedom. Furthermore, one feared a considerable reduction in the economic efficiency of the district. Overall, there is no discernible positive benefit for the citizens.

Possible effects

The effects of a possible freedom of the city of Neu-Ulm are unclear. This is because Neu-Ulm would be the first Bavarian city to leave its district. There are therefore no reviewers with the appropriate expertise or experience.

The city of Neu-Ulm mentions the bundling of tasks in just one authority as the only advantage of the freedom of district for citizens. New citizens in the city of Neu-Ulm have to register in the citizens' office. However, if you want to register a motor vehicle at the same time, you have to go to the district administration office approx. 1300 meters away. In the case of freedom from a district, going to the district office could be omitted. Personal registration and vehicle registration could be done for new residents with a single walk to the city administration.

As an advantage of the district freedom for the city of Neu-Ulm, the city administration names the possibility of shaping the future of the city independently.

The city of Neu-Ulm would need additional staff to fulfill new areas of responsibility. In the opinion of the Neu-Ulm district, however, it cannot be assumed that the new jobs to be created in the city can be saved in full in the district.

Study by the SME Institute for Social and Economic Research

The Chamber of Commerce and Industry supports and uses a study by the SME Institute for Social and Economic Research in Neu-Ulm on the consequences of freedom from the city of Neu-Ulm. The first results of this study were presented in October 2018: It came to the conclusion that the city would not be able to cover the financial and economic consequences of a district freedom in the following years. The district would be permanently impaired in its financial performance. As a unit, the city and district of Neu-Ulm would be much better equipped for the challenges of the future than on their own. The study was presented in detail on November 9, 2018. She speaks of around 75 million euros in additional burdens for the economy in the city and district in the first five years. This is also due to the double administrative structure. Furthermore, a district-free Neu-Ulm would only make up 5.5 percent of the total financial power and added value of the Danube-Iller region , while the district without the city would be 14 percent (the city of Ulm contributes 21.4 percent, the Alb-Donau district 13.5 percent at); thus the city has neither outgrown the district nor is it on par with the neighboring city of Ulm.

Criticism of the SME study

The then Mayor of Neu-Ulm, Gerold Noerenberg, criticized in November 2018 that he had still not received a detailed version of the study. As early as October 19, 2018, he said: "The investigation is not worth the paper on which it is printed."

Possible subsequent exit of the Elchingen community from the district

In the municipality of Elchingen , which is the only district municipality north of the Danube and thus geographically closer to Ulm and Baden-Württemberg, voices were raised during the debate to also leave the district in the event of nuxit and to contact the city of Ulm or to join the city of Langenau in the Alb-Donau district .

Referendum

At the first information events in the city area, criticism of the information policy on the part of the city leaders on Nuxit was increasingly loud. Citizens and also local politicians from various parties therefore spoke out in favor of a popular vote in order to vote on freedom of the district. Lord Mayor Gerold Noerenberg rejected such a referendum because he considers the issue to be too complex.

By the end of April 2018, an alliance of parties and citizens had collected 3,319 signatures to start a referendum - more than the necessary quorum required. On May 16, 2018, the Neu-Ulm city council declared this petition to be inadmissible and rejected it with 27 to 13 votes. In particular, formal errors in collecting signatures were cited as the reason. The citizens' initiative now wants to challenge the rejection by the city council in court, but has also started a new collection of signatures in the city and district for a referendum. This would require 50,000 signatures.

Petition to the Bavarian State Parliament

In response to the rejection of the referendum , the citizens' initiative launched a petition to the Bavarian state parliament in accordance with Article 115 of the Bavarian Constitution . On September 19, 2018, all parliamentary groups in the Neu-Ulm district council agreed that the petition “Neu-Ulm remains in the district? Yes, please! - The large district town of Neu-Ulm should remain part of the district of Neu-Ulm ”.

On April 2, 2019, the petition was handed over to Martin Runge , the chairman of the Interior Committee of the Bavarian State Parliament, with around 10,500 signatures .

Political positions

City Council Neu-Ulm

The CSU city council group is unanimous in favor of the Nuxit. In the FDP, all city councils are against the Nuxit. There are supporters and opponents in the city council groups of the SPD, the FWG and the Greens (as of August 2018).

District council of Neu-Ulm

On October 19, 2018, the district council passed an official statement with 44 votes to 9: The district council "... asks the competent authorities and the Bavarian state parliament to reject the application for freedom from district". The district fears “massive financial losses” with a Nuxit, which are estimated at between 6.7 and 8 million euros annually for the years 2018 to 2021. Furthermore, a “bureaucracy build-up” would take place, since unnecessary duplicate structures would have to be created in the administrations. The CSU parliamentary group leader Franz Clemens Brechtel spoke of a “lose-lose situation”, a state in which there are only losers.

District Administrator Neu-Ulm

District Administrator Thorsten Freudenberger would like Neu-Ulm to remain in the district. He warns of the negative financial and structural consequences of a nuxit. Neither side would benefit from the city leaving, as expensive dual administrative structures would have to be created.

Free voters

Parliamentary group

The parliamentary group of Free Voters announced in May 2019 that they would vote against the Nuxit in a possible vote in the Bavarian state parliament.

District association Neu-Ulm

The Neu-Ulm district association of free voters spoke out in March 2018 strictly against the Nuxit. It would have serious disadvantages, especially for the peripheral communities.

Chamber of Commerce and Industry

The IHK regional assembly Neu-Ulm sees a spin-off from the district with "great worries" from an economic point of view. According to the Chamber of Industry and Commerce, there is not yet a sufficient number of figures to be able to evaluate the Nuxit. The pending transaction costs have only been presented “roughly” (as of June 2018). But from the point of view of the economy, the freedom of the district will entail significantly higher indirect and direct costs, which in the end the taxpayer will have to pay.

The IHK assumes that the efficiency of both the district and the city is initially weakened on both sides when the Nuxit is completed.

Bavarian community day

The district association Neu-Ulm of the Bavarian Municipal Assembly rejects a district freedom of Neu-Ulm. The representatives of the municipal assembly criticize the fact that the Nuxit would create double structures in the district and city administrations, which would cost money above all. The municipalities fear "more effort without creating added value for the citizens both in the city of Neu-Ulm and in the possible rest of the rural district."

Bavarian District Day

The President of the Bavarian District Association , District Administrator Christian Bernreiter , speaks out against the Nuxit. He warns of a "conflagration in Swabia" should Neu-Ulm actually leave the district and do this. The city should remain part of the district. "Because cities belonging to the district drive better."

Association of Taxpayers

Rolf von Hohenhau , the President of the Bavarian Association of Taxpayers, rejects the city of Neu-Ulm's planned exit from the district. In January 2019, the association warned against a foreseeable waste of taxpayers' money - and against jeopardizing “the exemplary, constructive and amicable cooperation of the district with the city of Neu-Ulm, which has existed for 46 years”. An exit from Neu-Ulm will cost significantly more than it actually benefits the general public. The Nuxit would tie up considerable human and financial resources on both sides over the years. The Nuxit would require more staff on both sides. The need for spatial resources will not decrease as much in the district as it would increase in the city. The total follow-up costs are not foreseeable. “What is needed now is level-headed, responsible mandate holders who set the course for community and a return to normality in good time,” said von Hohenhau.

Club of Industry Ulm / Neu-Ulm eV

The Ulm / Neu-Ulm Industry Club is critical of the Nuxit. He would prefer the city of Neu-Ulm and the district to stay together.
