Otto-Friedrich Freiherr von Gamm

Otto-Friedrich Freiherr von Gamm (born November 30, 1923 in Schwerin ; † March 2, 2001 ) was a German legal scholar and a judge at the Federal Court of Justice from 1970 to 1990 . As chairman of the First Civil Senate and author of numerous publications, he exerted significant influence on the development of copyright law and industrial property protection in Germany.

Life

Gamm grew up in the von Gamm family of professional officers , which is why his childhood was characterized by frequent changes of location. In 1940 he passed his Abitur and then performed the mandatory Reich labor service as well as military and military service. In 1945 he was taken prisoner by the US as a lieutenant , from which he was released in autumn 1946. He then settled in Munich and began studying law at the University of Würzburg , which he completed in 1950 after seven semesters with the first state examination. Three years later he passed the second state examination. He was also in 1962 when Friedrich August von der Heydte a competition law topic for Dr. jur. utr. PhD.

In 1954 he took up a position as a court assessor at the Munich I district court . Already here he was almost exclusively concerned with commercial legal protection and copyright. Two years later he was appointed district court advisor, and in 1965 he was promoted to director of the Munich I district court. During his time at the regional court, he was chairman of a chamber responsible for commercial legal protection, copyright and antitrust law for several years .

In 1970 he was appealed to the Federal Court of Justice . Here he was a member of the 1st Civil Senate , whose competence extended to copyright, competition and trademark law. Since 1973 he was also a member of the Cartel Senate . In 1978 he completed his habilitation on "Intellectual property rights and performance protection in EEC antitrust law". In July 1978 he was appointed chairman of the 1st Civil Senate.

After previously teaching as a private lecturer at the universities of Würzburg and Heidelberg , he was appointed adjunct professor at the University of Heidelberg in 1985. When he reached retirement age, he left the Federal Court of Justice in November 1990. On this occasion he was honored with a commemorative publication. He then worked as a lawyer .

Gamm belonged to a commission of experts appointed by the Federal Ministry of Justice for commercial legal protection and for copyright, the board of trustees of the Munich- based Max Planck Institute for foreign and international patent, copyright and competition law and the entire board of the German Association for Commercial Legal protection and copyright as well as the relevant specialist committees for competition and trademark law and for copyright. He also chaired the arbitration board formed in accordance with the Copyright Administration Act.

Freiherr von Gamm was buried in the forest cemetery in Munich.

The first publication by Gamm in 1957 dealt with the "fundamental questions of film law ". In the period that followed, numerous individual accounts and monographs appeared on various legal matters, for example on cartel law in the EEC area (1961 and 1969), competition law (1964), the trademark law (1965), design law (1966 and 1989), and the copyright law (1968) , on commercial law (1970) and on antitrust law (1979 and 1990). In 1987 he published a systematic overview of competition and competition procedural law. In Reimer's commentary he took over the explanation of competition law (1972), and in the series “Heymanns Taschenkommentare” published a commentary on the law against unfair competition (1975, 1981 and 1993).
