University Council (Austria)
The University Council is an organ of university self-administration at Austrian universities. Along with the rectorate , the rector and the senate, it is one of the highest organs of every university. Its function corresponds roughly to that of a supervisory board in a corporation . The University Council was introduced in this form by the Universities Act 2002 . The competencies of the previously existing university advisory board were taken over and significantly expanded.
In addition to the collegiate and individual its members - be - most commonly university council (or member of University Council ) called.
Composition and term of office
A university council consists of either 5, 7 or 9 members. The size is determined by the founding convention of a university, changes can be decided by the Senate with a two-thirds majority. 2, 3 or 4 of the members are elected by the Senate (depending on size), and the same number are appointed by the Federal Government on the proposal of the Federal Minister for Science and Research . The last member is appointed by mutual agreement by the members of the University Council.
According to Section 21 (3) of the University Act 2002, the members should be active in responsible positions in society, in particular in science, culture or business, and should be able to contribute to the achievement of the university's goals and tasks due to their excellent knowledge and experience . Members of the respective university or the responsible federal ministry are excluded. Members of the federal government or a state government, members of the National Council, the Federal Council or any other general representative body and functionaries of a political party may not be appointed to the University Council. Any activity within the last four years in one of the above-mentioned functions also excludes a position as a university councilor.
The term of office of the University Council is five years. A single re-election of individual members is permitted.
tasks
The tasks of a university council roughly correspond to those of a supervisory board of a corporation . They are defined in Section 21 (1) of the 2002 Universities Act and include (excerpt):
- Approval of the development plan, the organization plan, the draft performance agreement and the rules of procedure of the rectorate (in each case on the proposal of the rectorate)
- Election of the Rector from a list of three proposed by the Senate and conclusion of the employment contract with him / her
- Election of the vice-rectors on the proposal of the rector
- Approval of the establishment of companies and foundations (on the proposal of the Rectorate)
In order to fulfill its tasks, the University Council is entitled to obtain information on all university matters. The university bodies are obliged to provide information and to cooperate with the university council.
