6. Criminal Senate of the Federal Court of Justice
The 6th criminal panel of the Federal Court of Justice is one of six criminal panels of the Federal Court of Justice (BGH). It was established in Leipzig with effect from February 15, 2020 and is housed together with the 5th criminal senate in the Villa Sack. From 1954 to September 30, 1956, there was already a 6th criminal senate.
history
1956-1958
The 6th criminal senate was established in Karlsruhe in 1954 ; the state security matters were assigned to him. Friedrich-Wilhelm Geier , President of the 5th Criminal Senate, took the chair . On October 1, 1956, the 3rd Criminal Senate was dissolved and the 6th Criminal Senate was henceforth called the 3rd Criminal Senate. Geier remained chairman until 1958 and then took over the chairmanship of the 1st criminal senate .
Since 2020
On February 15, 2020, the 6th Penal Senate was re-established on the basis of Section 130 Paragraph 1 Sentence 1 and Paragraph 2 of the GVG . The reason for the establishment of the Senate in Leipzig is the so-called slip clause, which was introduced as part of German unification , according to which an existing criminal senate must be relocated from Karlsruhe to Leipzig when a new civil senate is set up in Karlsruhe. The Federal Government takes the view that the establishment of a criminal senate in Leipzig also meets the requirements of the clause.
Jurisdiction
The (new) 6th Criminal Senate has taken over responsibility for revisions in criminal matters for the following higher regional court districts from the other Criminal Senates : Bamberg and Nuremberg (from the 1st Criminal Senate), Rostock (from the 2nd Criminal Senate ), Celle (from the 3rd Criminal Senate), Naumburg (from the 4th Penal Senate ) and Brandenburg and Braunschweig (from the 5th Penal Senate). No special responsibility is assigned to him.
