Nieder-Wöllstadt office

from Wikipedia, the free encyclopedia

The Nieder-Wöllstadt office was an office in the County of Solms-Rödelheim and subsequently in the Grand Duchy of Hesse .

function

In the early modern period , offices were a level between the municipalities and the sovereignty . The functions of administration and jurisdiction were not separated here. The office was headed by a bailiff who was appointed by the rulers.

history

With the Rhine Confederation Act of 1806, state sovereignty over the county of Solms-Rödelheim and its office in Nieder-Wöllstadt fell to the Grand Duchy of Hesse. This incorporated the area into the Principality of Upper Hesse (from 1816: "Province of Upper Hesse"). However, this happened with the restriction that the Counts of Solms-Rödelheim retained their traditional sovereign rights in administration and jurisdiction . They were now noblemen and also enjoyed the special protection of the federal act . This independent sovereignty naturally interfered with the Grand Duchy's claim to the state monopoly of force .

From 1820 there were administrative reforms in the Grand Duchy of Hesse. In 1821, jurisdiction and administration were separated and the offices dissolved at the lower level . For the previously perceived by the offices administrative tasks were district districts created for the first-instance jurisdiction district courts.

The Nieder-Wöllstadt office was also to be dissolved, but this could not be carried out so quickly because of the transverse rights of the Counts of Solms-Rödelheim. The administrative tasks of the Nieder-Wöllstadt office were assigned to the district of Vilbel as early as 1821 (from 1829 "district of Friedberg"). The village of Einartshausen was spun off and, in terms of administration, added to the newly formed district of Hungen in 1822 . A regulation regarding the tasks in the jurisdiction has not yet been made, so that the Nieder-Wöllstadt office remained the court of first instance for the time being. The negotiations between Solms-Rödelheim and the state dragged on. Only in 1823 did this lead to a result: the class lords transferred the exercise of their rights to the state, the Grand Duchy acted “in the name” of the class rule. With regard to Einartshausen, the change to the Hungen office was confirmed again and it was assigned to the Laubach district court with regard to jurisdiction .

Components

At the time of its transition to the Grand Duchy of Hesse in 1806, the Nieder-Wöllstadt office included:

The area of the former Nieder-Wöllstadt office was in the Wetterau , in the districts of today's cities Friedberg , Karben , Niddatal , Rosbach vor der Höhe and Wöllstadt . The only exception was the remote Einartshausen exclave , which today belongs to Schotten in Vogelsberg .

Law

In the Nieder-Wöllstadt office , the Solms land law was a particular law . It remained valid law throughout the 19th century and was not replaced until January 1, 1900 by the civil code that was uniformly valid throughout the German Empire .
