Matthias Berlich , latinized Matthias Berlichius , (born October 9, 1586 in Schkölen (near Weißenfels ); † August 8, 1638 in Leipzig ) was a German legal scholar and lawyer.

Life

Matthias Berlichius' father Nicolaus Berlichius was the mayor of Schkölen . His mother was Marie Berlichius (née Kodritzsch) (1555–1633), daughter of the district judge Egidius Kodritzsch in Seidewitz and of Catharina Vogt.

He studied law in Jena and Marburg , in the latter place under Hermann Vultejus . He received his doctorate in 1610. From 1611 he was a lawyer and legal counsel in Leipzig . He also gave private lectures there. Berlichius married Christina Große, daughter of the Leipzig publisher Henning Große , on July 25, 1612 . He had three children with her:

He died of a stroke and was buried on August 10, 1638 in the St. Pauli University Church in Leipzig .

Legal work

His contemporaries admired his extensive legal knowledge.

His most important work was the Conclusiones practicabiles , a presentation of common law in five volumes, published between 1615 and 1619. This treatise had eleven editions by 1739. In 1625 the Decisiones appeared , which reflect the Saxon legal practice of the time. Berlichius was influential in the field of criminal law, whereby his goal was an accurate representation of the criminal offenses.

Benedikt Carpzov the Elder orientated himself so closely to Berlichius in terms of content that it was later called Nisi Berlichius berlichizasset Carpzovius non carpzoviasset (German, for example: If Berlichius had not berlichiiert, Carpzov would not have been able to carpzovieren .).

Matthias Berlichius' nephew was Burkard Berlichius (1603–1670), a lawyer and civil servant in Dresden. This in turn was an ancestor of the March revolutionary Gustav Struve , the Prussian Prime Minister Otto von Manteuffel and the Field Marshal Edwin von Manteuffel . The great niece Susanne Berlich (1647–1699), herself a religious writer, married the lawyer Georg Adam Struve on August 30, 1663 .
