Walther Fürst (lawyer)

Walther Fürst (born February 10, 1912 in Tauberbischofsheim ; † October 23, 2009 ) was a German lawyer and President of the Federal Administrative Court (BVerwG) .

biography

The son of Professor Johann Prince graduated after visiting the Humanist Margrave High School in Karlsruhe - Durlach and the Berthold-Gymnasium in Freiburg to study law at the Albert-Ludwigs-University of Freiburg and the University of Kiel . After the second state examination and the graduation to the doctor of law degree, he joined in 1938 as assessor in the public service of the Republic of Baden . During the Second World War he was a member of the Wehrmacht and was last promoted to lieutenant in the intelligence service.

After the end of World War II, he was in 1947 Councilor in the District Office Emmendingen , where he the function of the chief administrative officer executed as Temporary Administrator. In 1950 he became the Administrative Court Director of the Administrative Court (VG) Freiburg . At the same time he was initially part-time judge at the Baden State Court in 1951. After the establishment of the state of Baden-Württemberg , he was elected judge at the provisional state court for the state of Baden-Württemberg in 1952 .

Just one year later, in 1953, after the Federal Administrative Court (BVerwG) was founded in Berlin, the Judges' Committee of the Bundestag elected him one of the first judges at the Federal Administrative Court. In 1956 he became presiding judge of the VI. Senate of the BVerwG, which was responsible for public service law. In 1971 he was appointed Vice President of the Federal Administrative Court.

After the then President of the BVerwG, Wolfgang Zeidler , went back to the Federal Constitutional Court as a judge in 1975 , he finally became President of the Federal Administrative Court in 1976 after lengthy discussions about the appointment of a new President . In 1980 he was replaced by Horst Sendler .

In addition to his judicial work, Fürst was also a professor at the universities of Berlin and at the Berlin Administrative Academy as well as a member of the Berlin Judicial Examination Office. Walther Fürst was known to the professional public as the long-time editor of the "Gesamtkommentars Public Service Law" (GKÖD), which was published in volumes I Federal and State Civil Service Law, Judicial Law and Military Law, II Federal and State Disciplinary Law, III Federal and State Salary Law Laender, IV Law of Public Employees and V Personnel Representation Law of the Federation and the Laender is probably the most extensive work on this topic. Fürst only ended this editorial work in June 2009.

In 1983, Federal President Karl Carstens appointed him to the Expert Commission for the assessment of party financing . Fürst was a member of the Catholic student union K.St.V. Germania Hohentwiel Freiburg in KV .

On his 90th birthday, companions dedicated a commemorative publication to him (Public Service Law in Transition [2002]).
