Werner Theodor Martini (born June 14, 1626 in Salzwedel , † March 10, 1685 in Wittenberg ) was a German legal scholar.

Werner Theodor Martini was born in 1626 as the son of the future councilor and mayor Johann Mertens in the Neustadt of Salzwedel . He attended school in Salzwedel, Brandenburg and Lüneburg. He studied law from 1647 at the Universities of Rostock , 1651 at the University of Frankfurt (Oder) , and later in Leipzig and Jena .

Martini made long study trips with the gentlemen von Eltz through Germany and Holland and established first relationships with important scholars. Then he came to Heidelberg as court master of the Baron von Schulenburg via Kassel and Marburg . There he gave private tuition in the "rights" (legal studies) until 1658 until he finally acquired his doctorate in Jena in 1659 .

His skills in law and politics , which he had acquired at various universities at home and abroad , his knowledge of foreign languages ​​and the experience he gained at royal courts, brought him high-level recommendations. Margrave Christian Ernst von Baireuth used Martini for example . This earned him the professorship for law at the University of Leucorea in Wittenberg in 1662 and initially an observer position at the court .

Later he got a position as an appellate councilor in Dresden and the assessor at the Lower Lusatian regional court. In the summer semesters of 1662, 1669, 1677 and 1683 he was rector of the University of Wittenberg .

Martini married Magdalena Sibylla in Dresden in 1662, the daughter of the Saxon court preacher Jakob Weller von Molsdorf. From this marriage eleven children were born, including a son of the same name, who also distinguished himself as a lawyer, but died in 1698. The children are known:

Works (selection)

Martini's publications include “Jurisprudentia criminalis” and “Constitutiones Electorales Saxonicae”. The “Jurisprudentia criminalis” published as a book in 1669 consists of ten dissertations, which deal with the individual main materials of criminal law. Martini also presented the feudal law of that time in a similar form. Other disputations, however, deal with parts of civil law and constitutional law, including Saxon law. Martini dedicated a series of dissertations to the latter, which was published in 1684 under the above-mentioned title “Constitutiones Electorales Saxonicae divi Augusti, notis theoreticis et praticis illustratae”.
