The Altötting District Court is a court of ordinary jurisdiction and one of 73 district courts in Bavaria . It is located in Traunsteiner Str. 1 a in Altötting .

history

Since the early Middle Ages , there was a jurisdiction in neighboring Neuötting , the district court Neuötting. From 1810 the district court Altötting (older order) existed , which was a state administrative unit of the lower level until 1862, with administrative tasks similar to today's districts . At the same time, the regional court of the older order was also the judicial organ of the lower jurisdiction and thus the entrance instance of the ordinary jurisdiction , comparable to today's district court . But it also performed tasks of the higher judiciary (like today's regional courts ) and performed notarial ones Activities.

The function of the regional courts as an administrative authority and at the same time a judicial body was viewed as a structural flaw in the Bavarian constitution , as it affected judicial independence . In addition to his office as judge, the judge was bound by instructions through his simultaneous function as an administrative officer. To remedy this deficiency, the Judiciary Act was passed on January 10, 1861. This law made it possible to separate the judiciary and administration. The administrative tasks were separated from the regional courts and transferred to the newly created district offices . The remaining institutions for the administration of justice initially retained the designation of the regional court.

On the occasion of the introduction of the Courts Constitution Act on October 1, 1879, the Altötting District Court was set up, the district of which was the Altötting District Office . In 1973 the Burghausen District Court was abolished and declared the district court branch of the Altötting District Court for Burghausen and the communities in the surrounding area. The branch was closed in 2006.
