The Reiss-Engelhorn-Museen (abbreviation rem ) are a museum association based in Mannheim that operates several museums , cultural institutes and research facilities there. They are a municipal company owned by the city of Mannheim. The Reiss Engelhorn Museums are comprehensively supported by the non-profit rem gGmbH , which brings together several foundations to promote the Reiss Engelhorn Museums.

history

The Mannheim entrepreneur Carl Reiss (1843–1914), in agreement with his sister Anna Reiss, transferred his entire fortune to the city of Mannheim for the construction of a Reiss Museum in 1913 . However, this museum could only be realized after the Second World War and the reconstruction of the Mannheim armory in 1957, which was then called the Reiss Museum . The industrialist Curt Engelhorn (1926–2016) and his wife Heidemarie founded the Curt Engelhorn Foundation for the Reiss Engelhorn Museums in 2001, which financially supports the former Reiss Museum with around 25 million euros . The museum was then renamed the Reiss-Engelhorn-Museen .

In 2014 rem gGmbH was founded. This bundles the activities for the Curt Engelhorn Foundation, the Bassermann Cultural Foundation Mannheim and the Blackberry Foundation and is responsible for part of the museums' operational business. For example, it realizes special exhibitions, coordinates scientific projects and is entrusted with the museums' press and public relations work.

The annual number of visitors to the Reiss Engelhorn Museums has fluctuated between 200,000 and 300,000 for years. In 2017 the museums counted 302,689 visitors; in the previous year the number was around 200,000 (2015: approx. 300,000, 2014: 201,660, 2013: 292,725).

Museum of world cultures

The facilities operated by the Reiss-Engelhorn-Museums include the following museums and research centers (the respective Mannheim squares in brackets ):

Armory Museum

In the Zeughaus Museum (C 5), an architecturally significant building from early classicism , the World of Antiquity exhibition shows objects from the Greeks, Etruscans and Romans in the basement. On the third floor, paintings, furniture, clothing, Frankenthal porcelain and silversmiths from the period from the 17th to the beginning of the 20th century are presented in the exhibition Kosmos Kunst . The collection of theater and literary history is also housed here . On the fourth floor, the International Photography Forum shows regularly changing special exhibitions with a focus on historical photography.

Museum of world cultures

The Museum Weltkulturen (D 5), housed in a modern building erected in 1988 opposite the Zeughaus, presents ethnographic and natural history, exhibitions from the archaeological collections and changing special exhibitions.

Bassermann House Museum

The Bassermannhaus Museum for Music and Art (C 4, 8) hosts exhibitions on music, art and cultures from around the world. The music history and ethnographic exhibition MusikWelten shows numerous European and non-European musical instruments.

Schiller House Museum

In the Schillerhaus Museum (B 5, 7), a multimedia production documents the life of Schiller , who lived in Mannheim from July 1783 to April 1785. His last apartment there was probably in the neighboring Hölzelschen House B 5, 8, which no longer exists today.

Forum International Photography

The Forum Internationale Photographie (C 5) with the oeuvre of the photographer Robert Häusser , part of the photo collection of the important photo historian and collector Helmut Gernsheim and the collection of the siblings Anna , Wilhelm and Carl Reiss is located in the Zeughaus Museum.

ZEPHYR - space for photography

ZEPHYR - Raum für Fotografie shows changing exhibitions of international artists who work with the media of video and photography . The exhibition rooms are located in the Bassermannhaus Museum in square C 4, as the name suggests phonetically.

Curt Engelhorn Center for Archaeometry

The Curt Engelhorn Center for Archaeometry (CEZA) (D 6) is a special laboratory for archaeometry operated as a non-profit limited company , which is closely connected to the Reiss Engelhorn museums. The research facility headed by Ernst Pernicka , which has existed since 2006, includes the Laboratory for Material Analysis and the Klaus Tschira Archaeometry Center at the Ruprecht Karls University of Heidelberg, which was set up in 2010 . Legal disputes

From 2015 onwards, a number of legal proceedings in which the Reiss-Engelhorn-Museums took action against users of photographs of their paintings received national attention. A long time ago, a user of an online media database ( Wikimedia Commons ) posted several picture photographs taken by a photographer from the Reiss-Engelhorn Museum, which had been scanned from an illustrated book published by the museum. The Reiss-Engelhorn-Museen then issued warnings against the hiring user, the operator of the media database and various other users, including the operator of an internet radio and the owner of an e-commerce website. While all parties agreed that the paintings on display were no longer subject to copyright protection, in the opinion of the museums, the photos taken by their in-house photographer were at least so-called simple photographs that were protected by the Copyright Act ( Section 72 ). This was countered by the fact that the recordings were on the one hand too simple to trigger copyright protection; but even if you see things differently, you have to exclude them from the protection of images, because otherwise the public domain of the painting shown would be undermined.

In May 2015, the museums obtained an injunction from the Berlin Regional Court against the owner of the e-commerce website, which prohibited the owner from making any further public access to the photography she used. In May 2016, another chamber of the court also sentenced the operator of Wikimedia Commons (in the main proceedings ) to no longer publicly reproduce 17 of the reproductions of paintings scanned from the illustrated book, as the recordings are protected photographs and are not in the public domain works of art shown arrive. The appeal directed against it was unsuccessful before the higher court. Since the Chamber Court did not allow the appeal , the defendant lodged an appeal against the Federal Court of Justice for non-admission ; In February 2019, the Federal Court of Justice rejected this after the legal issue had been clarified in the meantime (see below). Another subsequent user of the picture photographs held on Wikimedia Commons was initially able to successfully defend itself against the Reiss-Engelhorn Museum's injunctive relief and claims for damages before the Nuremberg District Court . Because at least if, as in the case of dispute, the museum forbids the independent photographing of a public domain painting with cameras or other technical means that it has brought with it, the court said that by granting photo protection “the public domain values ​​would be circumvented”. Therefore photo protection is excluded in the event of a dispute. The judgment did not become final: In the appeal instance, the defendant settled itself with the museums by paying a settlement amount.

The proceedings of the Reiss-Engelhorn-Museums against the private person, who originally put the painting reproductions on Wikimedia Commons , were brought before the Stuttgart courts. The museums did not limit themselves in their application to the reproductions of paintings by their in-house photographer scanned from the illustrated book, but also turned against recordings that the hiring user had made himself in the museum premises. Because he did this without permission, making the recordings publicly violated the property rights of museums. With this argumentation, the museums prevailed in the first instance before the Stuttgart Regional Court. The court sentenced the defendant both in terms of the scanned photos and in terms of self-made images on omission . The Stuttgart Higher Regional Court largely followed this, but allowed the appeal. The Federal Court of Justice rejected the appeal at the end of 2018. The scanned painting photos then enjoy light protection, because the photographer has to make decisions "about a number of creative circumstances, including the location, distance, viewing angle, exposure and section of the picture". With regard to the photographs they have taken themselves, the museums could demand that the photographer cease to make them accessible on the Internet (as compensation for damages ) due to a violation of their general terms and conditions ( §§ 280 Paragraph 1, 249 Paragraph 1 BGB).
