Protected part of the landscape (Salzburg)

Protected part of the landscape is one of the protection categories of the Salzburg Nature Conservation Act (§§12-15). The category includes small-scale parts of the landscape or green areas, in particular watercourses and waterfronts, ponds, small-scale moors, natural forest reserves, sites of minerals and fossils, groups of trees, parks, avenues and protective plantings.

Small-scale parts of the landscape or green areas can be declared protected parts of the landscape, provided they meet at least one of six requirements (NSG §12).

  • They are particularly formative for the landscape.
  • They contain special communities of plants or animals.
  • They have special scientific, cultural or small-climatic significance.
  • They are of particular importance for the networking of individual living spaces with one another.
  • They are important for recovery.
  • They are decisive for the appearance or the state of preservation of a natural monument.

In addition to the areas actually required, those areas can also be included in the protection area that are necessary for the existence of the protection area.

Protection procedure

The under protection procedure (NSG §13) is initiated by the responsible district administrative authority, whereby the under protection is carried out by ordinance by the district administrative authority. Before an ordinance is issued, the intended declaration of the part of the landscape or green area as a protected part of the landscape must be made known by the district administrative authority and announced in the relevant municipalities. For this purpose, an overview plan is to be made available for general inspection for six weeks. In addition, the Salzburg Chamber of Commerce, the Salzburg Chamber of Labor, the Salzburg Chamber of Agriculture and Forestry, the Salzburg Chamber of Agricultural Workers, the Salzburg Hunters Association and the Salzburg State Fisheries Association must be notified of the intended declaration, accompanied by an overview plan. Within the six weeks, landowners and other persons who can substantiate a legitimate interest can submit written statements about the project to the municipality. Thereupon, after the announcement period has expired, the mayor must immediately forward the collected statements to the district administrative authority at the same time as the announcement of the data of the announcement and any statement from the municipality. The different chambers can give their opinion on the project directly to the district administrative authority.

Temporary protection and interventions

With the announcement, the part of the landscape or green space intended for protection enjoys temporary protection (Section 14), which corresponds to that of the protected part of the landscape. Excluded from these restrictions are measures that serve the proper management of properties, in particular agricultural and forestry use and pasture-friendly hunting and fishing to the previous extent and do not significantly impair the value of the part of the landscape. The provisional protection expires when the Protection Ordinance is issued, but no later than after six months. However, this period can be extended by a further six months for important reasons. In a protected part of the landscape, all interventions that run counter to the protective purpose are prohibited (Section 15). The nature conservation authority can, however, permit certain measures in the ordinance or provide the possibility of an exemption for certain interventions, provided that these only have insignificant effects on the protection purpose of the protected part of the landscape.
