Any sexual activity outside of heterosexual marriage is illegal in the United Arab Emirates (UAE) and is punishable by at least one year in prison ( Article 356 of the UAE Criminal Code). Sexual activities between men ( homosexuality ) that can be classified as sodomy are punishable by death under Article 354 .

Homosexual acts that have been attempted but not carried out are rewarded with life imprisonment ( Article 355 ). The text of the law does not make it clear whether victims of rape are excluded. In the past, therefore, victims of rape were also punished. An example is the case of Alicia Gali , an Australian who was sentenced to five months in prison in 2008 in Fujairah . Gali was charged under UAE law of engaging in illicit sexual relations after three work colleagues say she was drugged and subsequently raped by three work colleagues.

In the individual Emirates homosexuality is punished differently, compared to the Criminal Code but usually punished more leniently in the UAE. This is what Article 80 of the StBG of Abu Dhabi a penalty of up to 14 years "unnatural sexual intercourse" for before. In Dubai, according to Article 177 of the local StBG, there is a prison sentence of up to 10 years for consented sodomy.

The constitution of the United Arab Emirates also does not grant any right to protection against sexual or gender discrimination . This protection is only provided to a moderate extent by international law , as the UAE has not signed and ratified the following important treaty:

Due to the still existing illegality, there are no LGBT communities in the United Arab Emirates. Homosexual people are pushed into the social underground.
