Consellu Superior Defeza no Seguransa

The Konsellu Superior Defeza no Seguransa KSDS ( Portuguese Conselho Superior de Defesa e Segurança CSDS , German  Supreme Council for Defense and Security ) is an advisory body to the President of East Timor . It was introduced with Section 148 of the East Timor Constitution .

tasks

The exact composition, organization and function of the KSDS is determined by law. According to Law 02/2005 Article 3, the KSDS advises the head of state:

  • on points relating to defense and security policy
  • in reviewing legislation and introducing new laws for the organization, function and discipline of the East Timorese Defense Forces (F-FDTL), the Police (PNTL) and all other security forces.
  • in the process of international defense and security agreements
  • when deciding on a declaration of war or a peace treaty
  • the decision to declare a state of siege or a state of emergency
  • when deciding on the appointment or dismissal of the Chief of the General Staff of the Defense Forces and his deputy
  • when deciding on the appointment or dismissal of the chiefs of staff of the individual armed forces and their deputies
  • in deciding on any other defense or security matter which the President of the Republic presents to the Councilors.

The Council decides on its own rules of procedure or changes. The President himself or at the request of the Prime Minister may invite observers to the meetings . However, the meetings are not held in public. The opinions of the Council are published in the Jornal da República and other channels as the Council determines. Comments on questions of the declaration of war, the conclusion of peace, the siege or the state of emergency are subject to special conditions.

Members

The body is chaired by the President and has civil and military members, whereby the constitution states that the number of civilian members should exceed the number of military members. According to Law 02/2005, the KSDS consists of 14 members. In addition to presidents and prime ministers this the ministers or secretaries of ministries are Interior , Justice , Defense and appearance . There are also three members of the East Timorese national parliament , the head of the secret service (SNI), the chief of staff of the East Timorese defense forces, the police commander and two citizens appointed by the president. The Council cannot meet without the President.

The members of the council cannot be prosecuted under civil, criminal or disciplinary law for statements or voting behavior within the exercise of their function. They may not be arrstiert or detained without approval of the Council and, unless in the act for offenses punishable by more than two years in prison. If a councilor is charged with such a crime, he or she can be suspended from the council. Council members may not appear as witnesses or experts in official trials without authorization.

In the exercise of their office, council members have free access to public places with otherwise restricted access. In their function, they have the right to receive information and publications from the official website that they consider necessary for their work.

With the parliamentary elections in East Timor in 2018 and the assumption of the 8th constitutional government of East Timor on June 22nd, the composition of the council also changed. In addition, Júlio Hornay was replaced as police commander in 2019.
