In the German federal states, binding plans with stipulations on spatial planning at the state level are referred to as the state development program or state space development program ( LEPro for short ), as a state development plan ( LEP for short ), in some countries also as a regional spatial planning program. They are the most important instruments of state planning .

The plans and programs are mostly a mixture of concrete objectives, spatial planning specifications and general guidelines for the further planning of the federal states, but also of the regions ( regional planning ) and municipalities.

Germany

State development plans and state development programs are state-wide spatial plans i. See the Federal Regional Planning Act (ROG). "The states create" according to § 6 ROG "legal basis for spatial planning in their areas (state planning) ...". According to § 6 ROG enact further regulations under state law, so that different terms and procedures have become established in the states. According to § 8 ROG “a comprehensive and superordinate plan must be drawn up for the area of ​​each country. In the states of Berlin , Bremen and Hamburg , a land use plan can take over the function of a “state plan” according to Section 5 of the Building Code .

State development plans and state development programs apply to the entire state, while regional development plans or development programs or regional programs are only issued for a specific region.

Baden-Württemberg

In Baden-Württemberg , the Ministry of Transport and Infrastructure draws up the on the basis of the State Development Act and the Regional Planning Act. The 2002 version is valid, which replaced the state development plan in 1983 and was drawn up by the Ministry of Economic Affairs. The coalition agreement for 2011 to 2016 provided for an amendment to the state development plan in connection with the realignment of energy and climate policy, but this project was rejected, which was confirmed for the future in 2013 and 2014 and was justified by the longer lead time for a state development plan change in comparison at the lead time of the actually made legislative changes.

Bavaria

The Bavarian State Development Program is the cross-sectional future concept of the Bavarian State Government . The State Ministry of Finance, Regional Development and Homeland has been responsible since October 2013 . The principles and goals that are important for spatial organization and development in Bavaria are laid down in the LEP, for example in the form of priority and reservation areas . The state development program was first drawn up in 1976. The current LEP came into force on September 1, 2013. The 2018 partial update is intended to give the municipalities more freedom to set up businesses and to restrict the definition of the power route. Professional associations from the fields of architecture, engineering, urban development and regional planning criticized in particular the deregulations on commercial settlement and insufficient attention to landscape areas, and in 2018 started the joint initiative "The better LEP for Bavaria".

For over 30 years the LEP has been the basis and guideline for the spatial development of the Free State . It represents an essential instrument for the realization of the main objective of Bavarian regional development policy: The maintenance and creation of equal living and working conditions in all parts of the country.

Berlin / Brandenburg

The joint state planning department Berlin-Brandenburg develops the central instruments for both federal states: the state development program 2007 (LEPro 2007; 2007) and the state development plan for the capital region (LEP HR; 2019) based on it .

The latter replaces the previously valid state development plan for Berlin-Brandenburg (LEP BB; 2009 and 2015) , which in turn includes the state development plans for the central local structure (LEP I; 1995) , for the more closely integrated area (LEP eV; 1998) and for the entire area of ​​Berlin-Brandenburg (LEP GR; 2004) .

Another plan with a limited spatial scope is the state development plan for airport site development (LEP FS; 2003) , which contains regulations in the area around Berlin Brandenburg Airport .

Brandenburg

The stipulations made in the state development plan are specified by the relevant regional planning association or are to be taken into account directly in the framework of the land-use planning .

Berlin

In Berlin, the urban development plan provides further details. This is available in six parts: StEP Industry and Commerce, StEP Climate, StEP Transport, StEP Supply and Disposal, StEP Living, StEP Centers.

The first urban development plan for traffic (StEP Verkehr 1.0) was drawn up in the years 2001 to 2003 (with progress reports January 2006 and June 2008) and had a target horizon of 2015. The second urban development plan for traffic (StEP Verkehr 2.0) has a target horizon of 2025. In the overarching road network of Berlin is named for two central areas with five main centers contained therein, as well as another seven medium-sized centers outside the inner city of Berlin .

Bremen

Bremen published an urban development program for the first time in 1971/1975. In 1999 the Bremen urban development concept was published by the Senator for Building, Transport and Urban Development, but it only covers the urban area of ​​Bremen. The concept consists of individual concepts for commercial locations, office locations, harbor areas, centers, city centers, green and leisure areas, traffic, for culture, leisure and tourism and for socio-spatial issues.

Hesse

In Hesse there is the state development plan drawn up by the Hessian Ministry for Economic Affairs, Energy, Transport and State Development as the highest state planning authority , and the regional plans of the municipal planning associations and communities for South Hesse , Central Hesse and North Hesse . The State Development Plan Hesse 2000 was changed in 2007 with regard to the airport expansion and in 2013 with regard to the use of wind energy.

The LEP deals with the state-wide spatial structure, the settlement structure with settlement development and the central locations, the open space structure, urban planning, traffic, the safeguarding and development of the natural foundations of life, agriculture and forestry, energy and raw material securing as well as supply and disposal of water and waste.

The state legal basis for the LEP is the Hessian State Planning Act (HLPG) .

Mecklenburg-Western Pomerania

In Mecklenburg-Western Pomerania , the state and regional development creates a joint supra- local framework into which the plans of the individual communities fit in, in order to coordinate the plans of other public authorities. The highest state planning authority is the Ministry of Energy, Infrastructure and State Development (Ministry of Transport), which integrates the spatial issues of the specialist planning of other departments, the neighboring states and the federal government into the state space development program. The LEP from 2005 was replaced by the LEP MV 2016, which came into force on June 9, 2016 and is expected to last for around ten years.

The four regional planning associations of the districts and independent cities with the offices for spatial planning and state planning (AFRL, as the lower state planning authority) develop the regional spatial development programs (planning association Mecklenburg Lake District, Rostock region, West Mecklenburg and Western Pomerania). The Rostock regiopole region has been under development in Germany for the first time in 2007; it is integrated into the Central Mecklenburg / Rostock planning association.

The upper and middle centers of the state also develop their own integrated urban development concepts (ISEK), which, in addition to building planning, are also intended to develop holistic models for a city, for example for a city that is family-, business- and sport-friendly and unbureaucratic . In addition, specific projects should be proposed and prioritized. The basis for this is also the development of forecasts for the population, household, vacancy, economic, tourism and housing demand development. These concepts are updated regularly, in many cities this happened in 2015.

Lower Saxony

The state spatial planning program Lower Saxony (LROP) was reorganized in 1994 and has been updated every four years since then. It was republished in 2008, and another update came into effect on October 3, 2012. The first objection period for the upcoming change ended at the end of 2014. This change includes, for the first time, extensive nature conservation goals such as the definition of priority areas for a nationwide network of biotopes. In addition, regulations on land use are included, as well as easy access to central locations with low overall costs. All priority areas for peat extraction should be phased out and replaced by priority areas for peat conservation and moor protection. In order to take into account the comments of those affected, a draft in autumn 2015 provides for the retention of 4,500 hectares of peat land as a compromise. So far, peat cutting has been permitted on 21,300 hectares. In addition to stipulations on the grid connection for the offshore wind farms, Gorleben is to be deleted as a priority site for a repository. For new conventional large power plants in the priority locations, an efficiency of at least 55 percent is required. North Rhine-Westphalia

The aim of state planning in North Rhine-Westphalia is sustainable development that reconciles social and economic spatial requirements with ecological requirements. The state development plan of North Rhine-Westphalia (LEP NRW) includes

  • the spatial structural objectives with the development axes of the settlement areas and the natural foundations of life such as open space, nature, landscape, forest and water;
  • the provision of land for residential building land, for the economy, for large projects for natural resources as well as for leisure and recreation;
  • the infrastructure for traffic, energy supply and disposal.

The state legal basis for the LEP is the State Planning Act (LPlG) .

In the years 2013 to 2017, the state planning of North Rhine-Westphalia developed a state development plan in a multi-stage process with the participation of the public, the associations and the state ministries, which came into force on February 8, 2017 in accordance with the state constitution. In the course of the state elections in 2017 and the changed majorities (black-yellow government coalition), another change procedure for the LEP was initiated. A participation procedure for the public and the planning authorities was opened from 7 May to 15 July 2018. The statements will then be evaluated and incorporated into the final version of the amended state development plan.

Rhineland-Palatinate

In Rhineland-Palatinate , the state development program (LEP) is set up by the Ministry of the Interior and Sport. The LEP IV is currently valid, which came into force in 2008 and was partially updated in 2013 with regard to renewable energies (previously LEP III from 1995). A second partial update on renewable energies, the third partial update of LEP IV, was published in 2017. In it, the content of the first partial update, especially in the area of ​​wind energy use, was readjusted.

Saxony

In Saxony , the State Ministry of the Interior published a report on spatial planning and regional development and the regional development plan - LEP 2003 - was drawn up, which replaced the LEP in 1994. The term state development is largely used for state planning.

The overriding guiding principle in Saxony was to lead sustainable spatial development, which harmonizes social and economic demands with its ecological functions, to a lasting, spaciously balanced order. It should be the task of regional development to work out essential spatially significant development goals on the basis of all spatial specialist planning, such as transport, economy, housing, supply and disposal, work and leisure.

The regional plans are to be developed by the regional planning associations (RPV) from the LEP as a framework for the urban development planning of the communities.

In addition to the regional plans, lignite plans are to be drawn up as sub- regional plans for the open-cast mining in the West Saxony and Upper Lusatia - Lower Silesia (e.g. Upper Lusatian mining district ) .

The regional development and action concepts (REK) for z. B. the Ore Mountains and Lausitz should complement the regional plans.

The state law basis is the law on spatial planning and regional planning of the Free State of Saxony (State Planning Act - SächsLPlG) of 2001.

The updated state development plan (LEP 2013) came into force on August 31, 2013.

Schleswig-Holstein

In Schleswig-Holstein , the State Development Plan 2010 (LEP) was drawn up by the Ministry of the Interior. It replaces the State Spatial Planning Plan 1998. The State Development Plan Schleswig-Holstein 2010 (LEP) was adopted by the State Government on July 6, 2010 and was announced by the Ministry of the Interior on July 13, 2010 (Official Gazette Schleswig-Holstein p. 719 State Development Plan) on October 4 Entered into force in 2010.

In the 2007 draft plan

  • the development policy components are given greater emphasis;
  • Concepts for spatial structure, settlement development, economic development, services of general interest and resource protection are included;
  • demographic change will be addressed;
  • include the territorial sea;
  • a “Strong Regions - Strong Cities” strategy should be included;
  • the framework of municipal housing development is renewed;
  • the climate protection policy objectives are presented.

In addition to the superseded regional spatial planning plan, there were five regional plans for Schleswig-Holstein south, south-east, east and north as well as for the technology region KERN (Kiel, Neumünster, Plön and Flendsburg-Eckernförde districts). The regional plans were drawn up by the state planning with the participation of the local authorities.

The state law bases form the law on state planning (Landesplanungsgesetz-LaPlaG) of 1996 and the state development principles law (LEGG) of 1995.

The state development plan is to be updated from 2015. Fracking should be excluded. This has already been announced so that the state planning authority can prohibit fracking during the update process. Prior to this overall update, point 3.5.2 (wind power) was suspended in June 2015 and a partial update on wind power was initiated.

Thuringia

In Thuringia , the Thuringian Ordinance on the State Development Program came into force on July 5, 2014, making the LEP 2025 legally binding. The first draft was published in 2011. In mid-2013 a second draft was presented to the public for discussion. It replaces the state development plan from 2004.

Austria

In Austria there are regional development programs for the federal states of Burgenland , Styria and Salzburg at the regional level of spatial planning .
