VG Media

VG Media (society for the exploitation of copyrights and ancillary copyrights of broadcasting companies and press publishers mbH) is a collecting society in Germany based in Berlin .

VG Media represents fiduciary copyright and neighboring rights of more than 180 German and international private television and radio broadcasting companies and around 200 digital publishing offers. It maintains license agreements with a total of around 34,000 contractual partners.

The German Patent and Trade Mark Office, as the state supervisory authority for collecting societies, approved VG Media as a collecting society in 1997.

Shareholder

The shareholders of VG Media are 25 media companies who split up the shares in VG Media so that 50% of the shares are held by private television and radio stations and a further 50% by press publishers. The shareholders are Antenne Bayern , Antenne Niedersachsen , Antenne Thuringia , Aschendorff Medien , Axel Springer SE , bigFM , Evangelischer Presseverband Norddeutschland , Funk & Fernsehen Nordwestdeutschland , Funke Mediengruppe , HandelsblattMedia Group , DuMont Mediengruppe , Münchener Zeitungs-Verlag , ProSiebenSat.1 Media , Hit Radio FFH , WeltN24 , Radio Regenbogen , Regiocast , Rheinische Post , RPR1 , Schleswig-Holsteinischer Zeitungsverlag , medienzentrum Berlin, Verlagsgesellschaft Madsack , Presse-Druck und Verlags-GmbH , VMG Verlags- und Mediengesellschaft and newspaper group Ostfriesland . The company was approved by the Federal Cartel Office on February 25, 2014 .

history

Since it was founded, VG Media has exercised copyrights and ancillary copyrights of private TV and radio broadcasting companies and was owned by broadcasting companies ProSiebenSat.1 Media AG , N24 Media , Antenne Bayern , Hit-Radio Antenne , radio ffn , Hit from 2010 to the beginning of 2014 Radio FFH , Regiocast , TOP Radiovermarktung, Antenne Thüringen , VMG Verlags- und Mediengesellschaft , Radio Regenbogen , RPR1 and bigFM .

Rights management

VG Media takes the rights to the cable retransmission and the public reproduction of radio broadcasts (towards cable network operators, housing industry, hotels, hospitals, fitness studios, prisons, trade fairs, etc.), the public perception of broadcast works (background music in restaurants, retail stores, banks, petrol stations, etc.) ), Audio and TV live streaming as well as program material in EPG , recording rights for media monitoring and rights to excerpts from press products. VG Media has set up appropriate tariffs for all licensed uses.

Like the other collecting societies (e.g. GEMA , VG Wort , GVL , AGICOA ), VG Media itself does not make a profit, but distributes all income minus administrative costs to the beneficiaries. The authorized media companies are over 70 companies from the private television sector ( e.g. ProSieben , Sat.1 , RTL , Sport1 , RTLZWEI , WELT , CNN , SBS 6 ), over 110 companies from the private radio sector ( e.g. Antenne Bayern , Hit Radio FFH , radio ffn and RPR1 ) and around 200 digital publishing offers. Licensing

VG Media has set up tariffs for various user groups in accordance with Sections 38–40 of the Collecting Societies Act. Before they are published in the electronic Federal Gazette , the tariffs are submitted to the German Patent and Trademark Office as the supervisory authority.

As provided for in the Collecting Societies Act, VG Media has concluded general agreements with numerous user associations in which the members of the associations are granted special conditions. The general contractual partners of VG Media include: B. the AMCU (Association of Music and Copyrights Users), BdG (Bund der Gemazahler), BVCD ( Federal Association of the Camping Industry in Germany ), BVGG (Federal Association of Gastronomy and Enjoyment), BVI , BVkom (Federal Association of Local Authorities ), DEGEMED (German Society for Medical Rehabilitation), DEHOGA , DSSV , DSW , DKG , EK Group, FRK , GdW , Haus & Grund , MFAK ( Central German Association for Antenna and Cable Systems ), Ring Deutscher Makler (Association of Real Estate Professions and Property Managers - State Association Berlin and Brandenburg ), TOM (Tourismus Oberbayern München), VDF and VDKM (Association of Commercial Music Users).

Cooperation partner

In various areas, VG Media also works with partners such as the German Cultural Council , the German Media Arbitration Court , the European Movement Germany , GEMA , the GVU , the Economic Forum of the SPD and the Economic Council of the CDU .

Lobbying

According to a report by the IT specialist portal netzpolitik.org from August 2019, VG Media is campaigning for a “lobby and media campaign against digital corporations”. VG Media commissioned a campaign from the Jung von Matt advertising agency , which u. a. is also supported by the organizations BDZV , Börsenverein des Deutschen Buchhandels , GEMA , Innocence in Danger and the VDZ . The aim, according to a leaked internal letter, is "indirectly to train legal politicians at national and European level, but also officials and judges who have to make decisions and judgments against the five digital monopoly Google, Facebook, Amazon, Apple and Microsoft". The strategy is "to [mention] the concerns of the senders and their rights holders, composers, music and press publishers, authors as well as the broadcasting companies and their respective individual authors (...) among other things, but not emphasized". According to the letter u. a. to use the message “protecting children and young people as an emotional finale”. The journalist Markus Beckedahl also criticized the “duplicity of the users” in data protection. They would demand better data protection regulations from the digital corporations, but at the same time lobby “massively against better consumer rights against non-transparent tracking within the framework of the ePrivacy Regulation at EU level”.
