incident

The ship gained international fame through a sea incident in the Indian Ocean off the south-west coast of India : On February 15, 2012, two fishermen were shot by military units from a merchant ship near the city of Alappuzha . After reporting to the Indian Coast Guard , the cargo ships in question in the sea area were asked to submit comments. The Enrica Lexie reported an incident: the Italian marines stationed on board suspected Somali pirates on an approaching fishing boat and opened fire. The fishing boat turned and two men died.

Enrica Lexie in front of Kochi

The Enrica Lexie was directed into the port of Kochi by the Indian Coast Guard . Two marines came to court there. This led to diplomatic tensions between Italy and India. Italy wanted to hear the case in an Italian court because the incident occurred in international waters .

The fishing boat came from the fishing port Neendakara, a district of Kollam . The two dead fishermen, Ajesh Binki (25) and Jalastein (45), were Tamils .

In April 2012, Italian authorities reached an out-of-court settlement with the victims' families to pay compensation of approximately € 145,000; the Indian federal government supported the localization of the incident in international waters. While the Kerala High Court sealed the settlement, a few days later the Indian Supreme Court ruled this practice illegal.

In early May, the Indian allowed Supreme Court of Enrica Lexie to leave the port. In early June 2012, the two accused were also released on bail . Italy had previously dismissed its ambassador Giacomo Sanfelice in protest . When the two accused did not return from a stay in Italy in March 2013, the Indian Supreme Court forbade the Italian ambassador Daniele Mancini to leave the country. Italy then sent its two soldiers back to India. In November 2013, Italian Foreign Minister Emma Bonino reported that the Indian government had promised that the accused would not face the death penalty. In February 2014, the Italian special envoy complained that two years after the incident there was still no indictment. Again Italy recalled its ambassador from India in protest. In September 2014, India allowed one of the two soldiers to leave the country again, this time for medical treatment. On June 26, 2015, Italy initiated arbitration proceedings against India under the Convention on the Law of the Sea and on July 21, 2015 also applied for an interim order against India at the International Tribunal for the Sea (ISGH) in Hamburg . On August 24, 2015, the ISGH ordered that both parties suspend all legal proceedings pending a decision by the court of arbitration that could exacerbate or widen the dispute; an interim order with regard to the two marines was not issued. Francesco Francioni (nominated by Italy), P. Chandrasekhara Rao (nominated by India), Jin-Hyun Paik , Patrick Robinson and Vladimir Golitsyn (chairman) were appointed as arbitrators in the subsequent arbitration proceedings . On April 29, 2016, the arbitration tribunal, which is part of the Permanent Court of Arbitration , issued an interim order that Italy and India should work together to relax the bond conditions so that the marine can return to Italy for the duration of the arbitration. India initially insisted on keeping the accused under the control of the Indian Supreme Court, which in turn could decide on his release, but the latter allowed Girone to leave for Italy at the end of May 2016.
