José Luís da Cruz Vilaça

José Luís da Cruz Vilaça (born September 20, 1944 in Braga ) is a Portuguese law scholar and university professor .

education

José Luís da Cruz Vilaça attended the Escola Secundária Sá de Miranda ( Liceu de Braga ) in Braga. He studied law at the University of Coimbra . There he graduated in 1966 with a degree in law ( Licenciado em Direito ). From 1966 to 1967 he was a university assistant at the Law Faculty of the University of Coimbra in the department of economics and political science. He also completed an additional course ( Curso Complementar ) in the subjects of political science and economics and obtained a Master of Science ( Mestrado ) in these subjects in 1968 .

From 1969 to 1972 he did his military service as head of the judicial department at the Portuguese Ministry of the Navy ( Ministério da Marinha ). From 1972 to 1974 he was Head of Political Science at the Law Faculty of Coimbra University. From 1975 to 1978 he was a fellow of the Calouste Gulbenkian Foundation . He completed postgraduate studies at the University of Paris . There he acquired in 1978 the doctorate in International Economics ( International Economics ). In 1979 he again took over the political science department at the University of Coimbra.

In 1981 he was a fellow at the Salzburg Seminar in American Studies in Salzburg . 1984-1985 he was Senior Associate Member at St Antony's College of Oxford University . From 2002–2003 he was visiting researcher at the School of Law at Fordham University in New York .

Career

politics

José Luís da Cruz Vilaça was a member of the Assembleia da República , the Portuguese Parliament , from 1980 to 1986 . In 1980 he became State Secretary in the Portuguese Ministry of Internal Administration ( Administração Interna ). In 1981 he became State Secretary at the Council of Ministers ( Presidência do Conselho ) of the Portuguese government. In 1982 he became State Secretary in the Department for European Affairs ( Secretário de Estado para a Integração Europeia ). He was a member of the local council ( Assembleia Municipais ) in Coimbra (1983) and Braga (1986).

European Union

From January 1986 to October 1988 he was Advocate General at the European Court of Justice in Luxembourg . In September 1989 he became President of the then Court of First Instance in Luxembourg, now the Court of Justice of the European Union . He held this office until September 1995. In later years he took on further tasks within the European Union . In 1999/2000 he was a member of the reflection group on the future of the judicial system of the European Communities. From April 2003 to February 2007 he was President of the Disciplinary Board of the European Commission . In 2012 he returned to the Court of Justice of the European Union as a judge, where he was elected Chairman of the V Chamber in 2015. In October 2018, José Luís da Cruz Vilaça retired from judging at the ECJ.

He was also in 2002 in Portugal Chairman of the National Commission on the reform and adaptation of the Portuguese competition law ( Presidente da Comissão de Revisão since Legislação since Concorrência ) to the European competition law . He was instrumental in drafting the relevant laws. These were in particular the Decreto-Lei 10/2003-Estatutos da Autoridade da Concorrência and Lei 18/2003-Lei da Concorrência .

From 1983 to 1985 he was professor at the Center for European Studies in the Law Faculty of the University of Coimbra. From 1983 to 1985 he was also head of the finance department. In 1988/1989 he was professor and head of the Institute for European Studies at the Universidade Lusíada de Lisboa in Lisbon . From 1996 to 2000, José Luís da Cruz Vilaça was again professor at the Universidade Lusíada de Lisboa . In 2001/2002 he was visiting professor at the Law Faculty of the New University of Lisbon ( Universidade Nova de Lisboa ). Since 2004/2005 he has been visiting professor at the Law Faculty of the Catholic University of Portugal ( Universidade Católica Portuguesa ) in Lisbon. He is also an associate professor at the Universidade International in Figueira da Foz .

Lawyer

José Luís da Cruz Vilaça has been a member of the Portuguese Bar Association ( Ordem dos Advogados Portugueses ) since 1969 . He's since 1996 to date (as of 2010) passenger and senior partner of PLMJ - AM Pereira, Sáragga Leal, Oliveira Martins, Júdice e Associados, Sociedade de Advogados, a leading law firm in Portugal. There he is head of the European Community Law and Competition Law department.

Research priorities

José Luís da Cruz Vilaça has published numerous books and articles in legal journals . He published in Portuguese , English , French and Italian . The focus of his academic work was national and European competition law , antitrust law , corporate concentration , sports law within the European Union, the relationship between national law and European law, the development of the European legal system and European constitutional law . Other priorities were fundamental rights in the European legal system and the enforcement of human rights , particularly with a focus on Latin America .

Awards

José Luís da Cruz Vilaça has received several awards. On April 12, 2006 he received the Grand Cross of the Order of Infante Dom Henrique ( Grã-Cruz da Ordem do Infante D. Henrique ), the Grand Cross of the Order of Merit of the Italian Republic ( Gran Croce dell'Ordine di Merito della Republica Italiana ), the Grand Cross of the Order of the Oak Crown ( Gran-Croix de l'Ordre Grand-Ducal de la Couronne de Chêne ). He is an officer of the French Legion of Honor ( Officier de la Légion d'Honneur de la France ).

Private

José Luís da Cruz Vilaça is married to Marie-Charlotte Opitz. He is the father of four grown children.
