The Schwalmstadt District Court (AG Schwalmstadt) (until 1867: Treysa Justice Office , until 1970: Treysa District Court ) is a court of ordinary jurisdiction in Schwalmstadt in the Schwalm-Eder district .

The seat of the court is in Schwalmstadt in Steinkautsweg 2. The judicial district of the district court Schwalmstadt includes the cities and communities Frielendorf , Gilserberg , Neukirchen , Oberaula , Ottrau , Schrecksbach , Schwalmstadt , Schwarzenborn and Willingshausen (each including all city and districts). All of them are in the Schwalm-Eder district .

The district court of Marburg is superordinate to the AG Schwalmstadt . The higher regional court of Frankfurt am Main and the Federal Court of Justice are superordinate in the next instance .

history

The city court of Treysa had existed since the Middle Ages. The jurisdiction of the lower courts was in the Hesse-Kassel by the bailiff of the Office Treysa perceived.

The reorganization of the judiciary in the Kingdom of Westphalia in 1807 led to the separation of jurisdiction and administration. The canton of Treysa was now responsible for administration, the Treysa Peace Court for jurisdiction. The peace court was subordinate to the district court of Marburg , which was responsible for the district of Marburg .

With the end of the Kingdom of Westphalia in 1813, the separation of jurisdiction and administration was reversed and the Electorate of Hesse reintroduced the Treysa office in 1814. With an edict of June 29, 1821, administration and justice were separated in Kurhessen. Now judicial offices were responsible for the first instance jurisprudence, the administration was taken over by districts (here the district of Ziegenhain ). The Treysa Justice Office was set up in the upper auditorium.

After the annexation of Kurhessen by Prussia , the justice office became the royal Prussian district court of Treysa in 1867.

With the entry into force of the Courts Constitution Act, the district court continued to exist under his name. With the merger of Treysa and Ziegenhain to form the town of Schwalmstadt , the name changed to Schwalmstadt District Court in 1970.

The judicial office and later the district court had their seat in Treysa town hall, which was built in the 15th century. After the need for space increased, the shell of the new district court building was built in 1938/39. The interior construction was delayed due to the war and the court used the not fully developed rooms. In particular, the meeting room was only completed after the end of the war. With the addition of the dissolved district courts of Ziegenhain , Neukirchen and Oberaula , the space requirement increased significantly. The two service apartments were therefore converted into service rooms and the roof was expanded.
