The Biedenkopf District Court is a court of ordinary jurisdiction in Biedenkopf in Central Hesse and one of five district courts in the district of the Marburg District Court . It is based at Hainstrasse 70–72 in Biedenkopf.

prehistory

After the lost war of 1866 , the Grand Duchy of Hesse had to cede parts of the territory to Prussia with the peace treaty of September 3, 1866 . This also included the Hessian hinterland (the " Biedenkopf district ") with the district of the Biedenkopf regional court . Regional courts have been the courts of first instance in the Grand Duchy of Hesse since 1821.

In June 1867, Prussia adapted the court organization to its own structure in the captured areas: the previous regional courts were repealed and replaced by local courts . The Biedenkopf District Court thus became the functional successor to the Biedenkopf Regional Court.

After the end of the Second World War , the Biedenkopf district court became the Hessian district court.

The Gladenbach District Court became a branch of the Biedenkopf District Court in 1968. In 2003 the branch was closed and completely integrated into the Biedenkopf District Court.

Angelburg , Bad Endbach , Biedenkopf , Breidenbach , Dautphetal , Gladenbach and Steffenberg belong to the judicial district of the Biedenkopf District Court .

Material jurisdiction

In addition to five judges and six judicial officers, three bailiffs , six civil servants in simple and middle-class positions and 13 employees are employed in the Biedenkopf district court . Judge Mirko Schulte has been the director of the Biedenkopf District Court since November 1, 2009. The district court of Marburg is responsible for commercial and association register matters , insolvency matters and criminal matters that are heard before the lay judge's court. The Hünfeld district court is exclusively responsible for the judicial dunning procedure in Hesse .

Instant assignment

The Biedenkopf District Court was initially subordinate to the Dillenburg District Court and the Wiesbaden Court of Appeal . With the entry into force of the Reich Justice Acts in 1877, the Marburg Regional Court was the court of second instance. In 1944 the court was briefly assigned to the district of the Limburg Regional Court before it came back to the Marburg Regional Court on January 1, 1949.

The Biedenkopf district court was initially located at 12 Hainstrasse. On August 8, 1891, the judicial administration acquired a 1508 m² property (at that time located on the outskirts) for 6,718.50 marks. The new building was implemented quickly, so that the court from 19. – 23. July 1893 was able to move into the new building at Hainstrasse 72. The land registry office first moved to Hainstrasse 12 before the house passed into private ownership in 1932.

As the space requirement in the district court increased, an extension was built in 1964/65 and used for the land registry. In 1977 the court was expanded again by taking over the annex building at Hainstrasse 70 (former Buderus Villa), which it used from July 1, 1977. The family department and probation department are now located there. Both buildings are cultural monuments due to the Hessian Monument Protection Act .

  • 1898–1923: District judge Karl Fuchs (later promotions to the secret judicial council)
  • 1913–1945: District judge Karl Gerstenberg (resigned as district judge)
  • 1926–1943: District judge Karl Wagener (resigned as district judge)
