District court Biedenkopf

from Wikipedia, the free encyclopedia

The district court Biedenkopf was a court of first instance of the ordinary jurisdiction in the province of Upper Hesse of the Grand Duchy of Hesse with its seat in Biedenkopf .

history

founding

From 1821 onwards, the Grand Duchy of Hesse separated jurisdiction from administration on the lower level.

In a first step, this was done in the areas of the state in which he exercised the sovereign rights in full ("Dominiallande"). The tasks previously performed by the offices have been assigned to district administrators (responsible for administration) and district courts (responsible for jurisdiction). The district of the Biedenkopf Regional Court was formed from the areas of responsibility of the previous Battenberg office , some places of the Biedenkopf office and places of the Blankenstein office . Here, the Breidenbach zu Breidenstein family held the patrimonial court in one of the communities in Grund Breidenbach , which initially continued to exist.

The higher authority of the Biedenkopf regional court was the Giessen court .

Further development

In 1823 the still existing rights of the patrimonial court lords in Breidenbach and Breidenstein were taken over by the state, so that the regional court Biedenkopf could now also judge unreservedly there.

On August 1, 1835, a number of communities were spun off from the district of the Biedenkopf regional court and merged to form the district of a Battenberg regional court (see: Overview).

In 1853 there were extensive changes to the layout of the judicial districts in the province of Upper Hesse. The reorganization came into effect on October 15, 1853. The Biedenkopf district court is expanding its local jurisdiction (see overview).

The End

After the lost war of 1866 , the Grand Duchy had to cede parts of the territory to Prussia with the peace treaty of September 3, 1866 . This also included the Hessian hinterland (the " Biedenkopf district ") with the district of the Biedenkopf regional court .

In June 1867, Prussia adapted the court organization to its own structure in the captured areas: the previous regional courts were repealed and replaced by local courts . The Biedenkopf District Court thus became the functional successor to the Biedenkopf Regional Court .
