The Montabaur District Court is a court of ordinary jurisdiction in Rhineland-Palatinate . It is one of the 15 district courts in the district of the Koblenz Regional Court .

Jurisdiction and seat

The seat of the court is Montabaur . The district court of Montabaur is responsible for the residents in the municipalities of Höhr-Grenzhausen , Montabaur , Ransbach-Baumbach , Selters (Westerwald) and Wirges with a total of around 102,000 court residents .

Jurisdiction

The district court of Montabaur is responsible for all matters that can be brought before a district court (except shipping register, partnership register and registry office matters ).

Special jurisdiction

In addition, it is also responsible for lay judges ' and juvenile lay judges' court proceedings as well as agricultural proceedings in the Westerburg district court . It is an insolvency court for the districts of the district courts of Diez , Montabaur and Westerburg. It also keeps the trade and association register for the districts of the district courts of Betzdorf , Diez, Montabaur and Westerburg. Since October 17, 2005 also for the districts of the district courts Altenkirchen , Linz am Rhein and Neuwied .

Superior courts

The District Court of Koblenz is superordinate to the Montabaur District Court. The competent higher regional court is the higher regional court Koblenz .

In the Duchy of Nassau , administration and jurisdiction were not separate. The offices, here the Montabaur office , were both administrative authorities and courts of first instance. However, the office was only responsible for civil litigation. The Dillenburg Criminal Court acted as the court of first instance in criminal law issues . The second instance in civil law issues was the Dillenburg court and appeal court .

After the March Revolution of 1848, administration and judiciary were separated (law of April 4, 1848). The administration was carried out by district offices , the offices were converted into courts of first instance. From 1849 the Montabaur judicial office was the court of first instance. However, this reform was given up again in 1854 and the old offices were reinstated.

With the annexation of Nassau by Prussia, administration and jurisdiction were separated and in 1867 the royal Prussian district court Montabaur was established and subordinated to the also new district court Limburg . On October 1, 1879, the changes to the Courts Constitution Act came into force. The Montabaur district court remained, but the Neuwied district court (from 1933: Limburg district court ) replaced the disbanded district court of Dillenburg .

Initially, the district court was housed in a building of the former Franciscan monastery in the so-called Amtmannsgarten. In 1910, today's office building was built and moved into at Bahnhofstrasse 47. From 1945 to 1952 the French used the district court building as the Gouvernement militaire . During this time, the district court was housed in the so-called Vincenz House of the Order of the Brothers of Mercy on Peterstorstrasse.

Since Montabaur was assigned to Rhineland-Palatinate after 1945 and Limburg an der Lahn to Hesse , the Montabaur District Court was assigned to the judicial district of the Koblenz District Court .

With effect from January 1, 1967, the districts of the district courts of Höhr-Grenzhausen and Selters, which were repealed at the same time, were added to the district court of Montabaur and part of the district court of Wallmerod, which was also repealed. The resulting shortage of space was initially met by renting a neighboring house. In 1984 it was possible to move into an extension on the site of the former prison, which is attached to the existing building complex.
