Jost von Trott zu Solz

Jost von Trott zu Solz (born October 24, 1944 in Bellers ; † December 18, 2009 in Berlin ) was a German lawyer specializing in open property issues / restitution law and founder of the Berlin law firm von Trott zu Solz Lammek.

Life

Von Trott zu Solz came from the Hessian noble family from Trott zu Solz . After serving in the army , where he later held the rank of captain as a reservist , he studied law at the Berlin Free University . There he was spokesman for the RCDS , later CDU district chairman and regional vice-president of the Junge Union . After completing his studies, he received his doctorate in 1975 under the later President of the Berlin Constitutional Court of the State of Berlin, Klaus Finkelnburg , in whose office he subsequently joined, with his work The State-Influenced Stock Corporation as an Instrument of Public Administration .

As a lawyer and notary , specialist lawyer for administrative law and specialist lawyer for tax law , he was a prominent lawyer in the field of public law . After reunification and until his death, he was one of the best-known lawyers in the field of property law and art restitution law . He represented hundreds of previous owners in asserting their claims, such as the heirs of the Mendelssohn & Co banking house . or the heirs to Max Silberberg in the restitution of van Gogh's Les Oliviers - the first return of a work of art on the basis of the Washington Declaration in Germany (together with the historian Monika Tatzkow ). In 2002 he founded his own law firm as a spin-off from White & Case together with five younger colleagues. In 2005 he represented the community of heirs of the entrepreneur and art collector Julius Freund to the Federal Office for the Settlement of Open Property Issues . In 2006 he advised the Berlin Senate on the Kirchner case , which dealt with the return of Ernst Ludwig Kirchner's Berlin street scene to the heirs . In total, he was involved in around a dozen positive restitutions of looted art. In March 2007 he was on the committee for culture and media as an expert on the public hearing on the subject of "The application of the principles of the Washington Declaration in Germany and in an international comparison - hearing on experiences in the field of restitution of cultural assets seized as a result of Nazi persecution and provenance research" invited. He advocated the establishment of a central authority where disputes between museums and the heirs of the robbed families could be resolved.

Von Trott zu Solz was co-editor of the magazine for open property issues and legal knight of the Order of St. John . Among other things, he was a sustaining member of the Max Planck Society .

He died in December 2009 after a brief, serious illness. His body was buried in the family cemetery in Solz . A memorial service was held in the St. Matthew Church in Berlin .
