In the context of the Prussian reforms of 1808, the judiciary was separated from the city administration in Bernau and the Royal City Court was created as an independent authority. The new court received the required office and prison rooms in the city hall free of charge. In 1839 the court was converted into a royal regional and municipal court . As such, it was now also responsible for Biesenthal and some neighboring villages. As a result of the revolution of 1848/49 , on April 1, 1849, the Royal Regional and City Court was repealed and replaced by a Royal District Court Commission , which also included the surrounding villages of the city of Bernau. After the establishment of the German Empire in 1871, the court organization in Germany was redesigned. In Bernau, a royal district court with lay judges was set up on October 1, 1879 , subordinate to Regional Court II in Berlin. Once again, the jurisdiction of the Bernau court expanded considerably.

In spite of the considerably increased tasks in the course of the 19th century, the court's offices were still in the town hall, which led to growing problems. August Wernicke wrote of constant "disputes and correspondence" between the city administration and the court in 1894 in his Bernauer Stadtchronik.

At the end of the 19th century, the need to create your own courthouse became increasingly evident. The space for a new building was found in what was then Kaiserstraße (today Breitscheidstraße), i.e. in a quarter in front of the walls of the city, which was shaped by the building enthusiasm of the founding years . The building - erected as a neo-Gothic brick building - could be occupied in 1903. Today it is a listed building. An extension building was handed over for use in 2003.
