As political contributions are donations to political parties referred to. The income from party donations, together with membership fees and public subsidies, form the basis of party funding .

Germany

In Germany , both natural and legal persons are allowed to donate an unlimited amount. Donations are tax-deductible to a certain extent; the parties also receive a state subsidy for income from donations.

In 2007, about 15% of the political parties were funded by party donations.

Traditionally, significantly more donations flow in election years than in other years. In 2009 ( federal election ), for example, it was around 6 million euros.

In 2011, a total of 2.03 million euros in large donations were made to the parties.

In 2012 it was 1.3 million euros (CSU 460,000 euros; CDU and SPD each around 260,000 euros, FDP 205,000 euros, Marxist-Leninist Party of Germany (MLPD) 115,000 euros, Greens 60,000 euros).

Publication obligation

The Political Parties Act (PartG) was significantly changed in 2002 ( Schröder I cabinet ): Since July 1, 2002, party donations of over 50,000 euros ("large donations") must be reported to the Bundestag President immediately and then published as printed matter and on the Bundestag homepage. Party donations over EUR 10,000 must be published in the parties' annual report ; they appear about one and a half years after the end of the year in question. Donations over 10,000 euros (and less than 50,000 euros) in the 2005 election campaign were for B. known in summer 2007.

Publication Practice

On January 28, 2010, the President of the Bundestag Norbert Lammert (CDU) instructed the parliamentary administration to publish large donations of more than 50,000 euros immediately in writing or on the Internet. Before that, they were published in collective overviews every four weeks. Political parties report large donations "usually one day after receipt by the President of the Bundestag".

The reason for this instruction were three donations totaling 1.1 million euros that the FDP had received from a hotel operator between October 2008 and October 2009.

2016

According to information from Lobbycontrol , over three quarters of donations from companies and business associations in the reporting year (2014) remained anonymous, 7% more than in 2013.

Prohibited donations

According to § 25 Abs. 2 Political Parties Law , political parties may not accept donations:

Tax deductibility

For party donations, the taxpayer is granted a reduction in income tax in accordance with Section 34g EStG. 50% of the donated amount can be deducted directly from the tax liability, a maximum of 825 euros (reached with a donation amount of 1,650 euros). In the case of joint assessments, the maximum deduction is 1,650 euros (reached with a donation of 3,300 euros). Due to the solidarity surcharge and church tax , the tax savings amount to a little more than half of the donation amount. With a church tax rate of 9% and the solidarity surcharge of 5.5%, the tax burden is reduced by a total of 57.25% of the party donations.

If more than 1,650 euros (or more than 3,300 euros in the case of joint assessment) are donated to parties per calendar year, the excess of the donation amount can be deducted as a special expense in accordance with Section 10b (2) EStG. For this part there is again a limit of 1,650 euros (joint assessment 3,300 euros). Since this only reduces the taxable income, the tax savings for this part depend on the personal tax rate.

If more than 3,300 euros (6,600 euros in the case of joint assessment) are donated annually to political parties, the excess is no longer tax-privileged.

Only party donations from natural persons are deductible - legal persons (companies) can not deduct party donations according to Section 4 (6) EStG. The deduction according to § 34g also applies to donations to municipal electoral associations , which, however, are not accountable.

State subsidies for "small donations"

Donations from natural persons are subsidized within the framework of the "state partial financing" of political parties with 0.45 euros for each euro. A maximum of EUR 3,300 per person will be taken into account.

  • In 2005, the FDP, CSU and CDU in particular benefited from party donations (donations made up 36%, 22% and 21% of the respective party's income).
  • Donations from natural persons to the SPD accounted for the lowest proportion of total income (6%).
  • Donations from legal entities to the DIE LINKE party (0.16%) had the lowest share of total income.

Austria

In Austria, since July 1, 2012, donations that exceed 50,000 euros in individual cases must be reported to the Court of Auditors immediately. The latter has to publish the donations on the website of the Court of Auditors, specifying the donor. This publication will be updated continuously. The parties sometimes circumvent timely disclosure by splitting donations of over 50,000 euros into several transactions under 50,000 euros.

In addition, each political party has to submit an annual report to the Court of Auditors on the nature of its income and expenditure by 30 September of the following year. Donations are to be shown separately in an annex to the annual report. Donations with a total amount of more than EUR 3,500 in a financial year must be reported, stating the name and address of the donor. The accountability report is to be published on the website of the Court of Auditors and on the website of the respective political party after it has been checked by the Court of Auditors. The annual reports published so far can be viewed on the website of the Court of Auditors.

Switzerland

Switzerland is one of the few European countries that do not have any special legal provisions on political parties, neither for their financing nor for the financing of election campaigns. Party donations are tax-deductible at federal level up to CHF 10,000 per year and at canton level up to an amount specified by the canton.
