Petra Hinz (2014)

Petra Hinz (born June 10, 1962 in Essen ) is a former German politician . From 2005 to 2016 she was a member of the German Bundestag for the SPD . After allegations of bullying by her employees and an affair involving false information about her own résumé, she resigned from all party offices at the beginning of August 2016 and resigned from the Bundestag on August 31, 2016. On September 5, 2016, she resigned from the SPD by her own admission.

Life and work

Petra Hinz grew up in Essen. According to her lawyers, she completed her school career at what is now the Erich Brost Vocational College in Essen in 1983 with a technical college entrance qualification. According to a member of the Bundestag's biography, she then completed a one-year internship at the Sparkasse and, from 1985 to 1987, trained in moderation and communication. According to her lawyers, from 1999 to 2003 she was employed as a "non-legal" employee. Hinz lives in the Margarethenhöhe district of Essen .

Political party

Hinz became a member of the SPD in 1980 and has held numerous positions since 1982, including as deputy chairwoman of the SPD sub-district of Essen since November 2003 . On July 18, 2016, she announced her resignation from this position. She was a member of the advisory speaker group of the Seeheimer Kreis .

In the Essen SPD, Hinz belonged to the party wing around the former Bundestag member Otto Reschke .

The SPD in Essen initiated party regulatory proceedings against Hinz because of the falsified curriculum vitae. Hinz announced shortly afterwards that she wanted to leave the SPD. According to her own statements, Petra Hinz left the SPD on September 5, 2016.

From 1989 to 2005, Hinz was a member of the Essen City Council , and from October 2004 to 2005 as deputy parliamentary group leader. From 2003 to 2005 she was also on the regional council for the administrative district of Düsseldorf . In 2005 she was nominated as a candidate for the Bundestag constituency Essen III after a battle vote by her subdistrict .

Since October 18, 2005, she has been a member of the German Bundestag. In the 2005 Bundestag election she won the Essen III constituency with 48.1% of the first votes and in the 2009 Bundestag election with 38.6%. In the 2009 to 2013 election period, Hinz was a full member of the Finance Committee and a deputy member of the Budget Committee, the Petitions Committee and the Committee on Transport, Building and Urban Development of the German Bundestag.

In the 2013 Bundestag election she received 39.5% of the first votes; According to the preliminary official final result, Matthias Hauer (CDU) received three more votes. A recounting of all around 150,000 ballots decided by the district electoral committee showed that Hauer had received 93 votes more than Hinz. She pulled on the national list of SPD North Rhine-Westphalia in the Bundestag one. There she was a full member of the Audit Committee (spokeswoman for her group) and the Budget Committee . She was also a deputy member of the Health Committee and the Municipal Subcommittee and, in her parliamentary group, deputy spokeswoman for the Municipal Committee.

On July 18, 2016, Hinz announced that he would not run for the Bundestag again because of allegations of bullying . In the course of the allegations it became known that Hinz had falsified her résumé. She has neither graduated from high school nor is she a lawyer. After these allegations became known, Hinz let her lawyers announce that she was stepping down from her Bundestag mandate. She told the press that she wanted to explain her resignation to Bundestag President Norbert Lammert , who was on vacation at the time. This has been criticized in the media, as a declaration of resignation is also possible with any German notary or a German embassy. According to the Bundestag, Hinz failed several attempts to get her an appointment with the Bundestag President in July. He had agreed to come to Berlin for it. Hinz, however, asked for an appointment in September.

The Essen SPD leader Thomas Kutschaty called on Hinz on August 1st to declare her resignation within 48 hours. The impression should not be given that she also wants to receive the payments for September. Under current law, Hinz could have performed her mandate until the end of the legislative period; she could not be forced to resign. The Wüppesahl ruling provided legal security for this . Because of Kutschaty's request and his ultimatum to Hinz to give up her mandate, the journalist Thomas Darnstädt accused him on Spiegel Online of disregarding the freedom of the mandate at the limit of compelling MPs ( Section 106 (1) No. 2 lit. a StGB ). She donated her last net earnings from her work as a member of the Bundestag to the Child Protection Association and the Peace Forum.

Investigation into tax evasion

In March 2009 it became known that the public prosecutor's office had initiated an investigation against Petra Hinz on charges of tax evasion and that her immunity had been lifted. She was accused of not having submitted proper tax returns to the tax office since 2003 . In July 2009 the proceedings against a monetary deposit were discontinued.

Allegations of bullying by employees

In July 2012 the working group of SPD employees in the German Bundestag invited Hinz to a discussion about the complaints of at least 20 former employees of their Bundestag office about "insane harassment" and "personal humiliation". Hinz refused to speak and instead wrote in an answer that the allegations were "unfounded". When Hinz advertised an office job again after the 2013 federal election , the working group sent a “warning circular” to potential applicants.

In mid-June 2016, a "group of former employees of Petra Hinz" anonymously sent a letter to various responsible bodies, such as the SPD state chairwoman and Prime Minister Hannelore Kraft , the general secretary of the SPD state association of North Rhine-Westphalia André Stinka and the members of the Essen SPD parliamentary group. According to this, "the daily tone in the Hinz office included personal insults, defamation, bullying, constant monitoring and discipline as well as the transfer of humiliating tasks". This letter was intended to prevent Hinz 'from running for the Bundestag again, which by then had already "worn out" over 50 employees and ultimately had none at all. The anonymous letter was also sent to regional and national media. Initially, only the freelance journalist Pascal Hesse (including Informer Magazine , Essen) took up research; He sent inquiries to Petra Hinz and SPD party committees on several levels, in which he set a deadline for answering until June 23, 2016, 12 noon. After the deadline passed with no response, he published an article as advertised. An article appeared on the website of the Westdeutsche Allgemeine Zeitung that same evening .

Hinz explained:

“Should the author of the letter be a member of the SPD - which I simply cannot believe - the Essen Social Democrats would have to ensure that he or she no longer remains a member. Someone who defamed Social Democratic elected officials in a detrimental way and pressured Social Democratic delegates no longer has any place in our party. It violates the basic principles of the party, solidarity, fair democratic discussion and the democratic election of our elected officials. "

On July 18, 2016, Hinz announced that she would not run again for the 2017 federal election because of allegations of bullying against her by former employees, which she rejected as unfounded. The Essen SPD chairman Thomas Kutschaty was surprised and stressed that Hinz had "received broad support for a renewed candidacy".

On July 22, 2016, a former employee, historian Norman Kirsten, spoke publicly for the first time about the allegations of bullying. Kirsten confirmed the allegations made in the anonymous letter in an interview. He “couldn't stand it” for more than half a year.

Fake CV

As a result of the article on allegations of bullying, the editorial team of Informer Magazine received a note from an SPD member in Essen about irregularities in Petra Hinz's vita, which the editorial staff addressed to Hinz in early July 2016. After discussions with another SPD member from Essen, this request was specified and renewed without any response. On July 19, 2016, the magazine then asked, among others, the President of the Bundestag Norbert Lammert , the SPD party chairman Sigmar Gabriel , the state chairman of the SPD North Rhine-Westphalia Hannelore Kraft and Essen's SPD leader Thomas Kutschaty for information.

On July 19, a lawyer from Essen published a statement on behalf of Petra Hinz, according to which she had given false information about her résumé for decades. Contrary to her earlier statements, which were published on the website of the Bundestag , among other things , she had neither acquired the general university entrance qualification nor completed a degree in law and thus did not pass any state law exams . She also invented information about working as a lawyer in a law firm , as a lawyer in the management of a group, and about freelance work. A new version of her résumé was published on her MPs website that same day. A large part of the information given in her biography up to then was therefore incorrect.

The public prosecutor's office at the Essen regional court announced on July 20, 2016 that, based on existing criminal charges , they were examining whether there was an initial suspicion of a fraudulent offense. The German Bar Association stated in August that it expected the phrase “lawyer in a law firm” to be seen as an abuse of professional titles . At the end of September 2016, the public prosecutor announced that a legal examination had shown that there was no initial suspicion of a criminal offense. Therefore, no preliminary investigation was initiated.

On July 26, 2016, it became public that the former SPD leader Dieter ten Eikelder in Essen had already received information about the falsified résumé from his own ranks in autumn 1989 and informed Otto Reschke , a member of the Bundestag at the time , who supported Hinz.

According to the former SPD member of the state parliament, Willi Nowack , the leadership of the Essen SPD knew about the false information in Hinz's résumé. In particular, Reschke and the North Rhine-Westphalian Minister of Justice Thomas Kutschaty had been informed; both deny that. Dieter ten Eikelder confirmed the long existence of rumors about Hinz's résumé.

According to a press conference of the sub-district chairman Thomas Kutschaty on August 4, 2016, Hinz wanted to resign from all offices of the Essen SPD, but initially wanted to keep her mandate in the Bundestag. This contradicts the announcement of July 18, 2016 on her website, according to which she wanted to resign from the Bundestag. On August 9, 2016, she announced in an interview with North Rhine-Westphalian newspapers that she would give up her mandate after completing clinical treatment; a point in time for this remained undetermined. Kutschaty commented on this, among other things: "Every additional day in office is another torture for everyone involved." On August 10, after further criticism from Hannelore Kraft, among others, Hinz declared that she wanted to resign from her Bundestag mandate with a notary on August 31, 2016 . The President of the Bundestag received a declaration of waiver by fax on August 23, but a waiver is only effective if the original of the notarized declaration is available. On August 31, 2016, Petra Hinz left the Bundestag.
