The German KRG Foodservice (formerly Yi-Ko Holding ) was the largest franchisee of Burger King in Germany.

Munich-based RM 1243 Vermögensverwaltungs GmbH relocated its headquarters to Stade in 2013, renaming it briefly to Yildiz Holding GmbH, and from April 23, 2013 it was renamed Yi-Ko Holding GmbH ( Yi-Ko is an acronym for the first letters of the surname of the shareholders Yildiz-Kolobov ) .

In May 2013, Yi-Ko Holding GmbH acquired Burger King GmbH , a subsidiary of Burger King Beteiligungs GmbH , in which the activities of Burger King Worldwide in the DA-CH region are bundled. At the time of the takeover, Burger King GmbH was operating 91 fast-service restaurants in Germany with over 3000 employees.

Conflict with Burger King Beteiligungs GmbH

On May 5, 2014, at their pressure, Burger King Beteiligungs GmbH ( RTL Team Wallraff report from April 28, 2014 ) and Yi-Ko Holding agreed on Yildiz's immediate resignation as managing director of Yi-Ko Holding. The managing director of Burger King Beteiligungs GmbH stated that the goal was "to eliminate operational grievances immediately, to ensure compliance with our high quality standards in our restaurants and fair working conditions for employees". However, Yildiz remained a partner in Yi-Ko Holding.

On July 23, 2014, the Yildiz confidante, Cologne franchise lawyer and until 2006 head of the legal department for Central Europe for Burger King, Dieter Stummel, was named as the successor to the managing director .

On November 18, 2014, the Burger King Group terminated all franchise agreements with Yi-Ko Holding with immediate effect. Among other things, the declaration made reference to repeated violations of operational and labor standards as well as the resulting damage to reputation. Another reason are indications that Yildiz, despite his resignation as managing director of Yi-Ko Holding, increasingly interfered in day-to-day business, which again led to the previously complained about conditions. On November 21, 2014, Burger King had Yi-Ko Holding forbid the further use of the brand name by means of an injunction . At that time, Yi-Ko operated 89 Burger King branches with around 3,000 employees.

On June 2, 2015, Burger King reached an agreement with what was once the largest German licensee to continue operating 84 branches: the entrepreneur Alexander Kolobov with his company Schloss Burger GmbH (SBG) again received the necessary license for the restaurants.

On December 10, 2014, the operating company Burger King GmbH , which belongs to the Yi-Ko Holding, filed an application for the opening of insolvency proceedings at the Stade District Court . The Hamburg attorney Marc Odebrecht was appointed provisional insolvency administrator. Burger King Germany allowed Odebrecht to use the brand and logo and wants to grant a million dollar loan. At the end of January 2015, the bankruptcy petition was withdrawn.

Yi-Ko Holding has been operating as KRG Foodservice since March 2015 .

criticism

Labor law disputes

Since the takeover of Burger King GmbH, the NGG union and members of works councils have criticized the worsened conditions for the members of the works councils and the employees. The conflict has already escalated in several court hearings, but without a final legal assessment. In August 2013, Yi-Ko-Holding responded to the union's allegations with a claim for damages against the NGG at the Hamburg District Court for defamation. According to the taz, Burger King GmbH has been represented by the lawyer Helmut Naujoks since June 2013 .

RTL report

In the report Team Wallraff : Undercover at Burger King , which was broadcast on RTL on April 28, 2014 , a team led by journalist Günter Wallraff reported on grievances in several Burger King restaurants of Yi-Ko Holding. The hygienic conditions in the kitchens, high pressure on employees and the working conditions were criticized. For example, marginally employed employees are said to have been refused payment of wages in the event of illness and an applicant for a shift supervisor position was denied the vacation pay guaranteed in the collective agreement and overtime payment. Yi-Ko Holding is involved in a legal dispute with around one in every fifteen of its 3000+ employees. A lawyer explained that due to the intricate corporate structure, it is practically impossible from Germany to access the profits of Yi-Ko Holding , which are passed on through the offshore financial centers of Cyprus and the British Virgin Islands . According to RTL, neither Yildiz personally nor Burger King GmbH, which belongs to Yi-Ko Holding, responded to the request for a comment.

Burger King Beteiligungs GmbH , which is part of the Burger King Corporation , stated after the broadcast that it was working on “developing and implementing an action plan with this franchisee to prevent such actions in the future”. Burger King Germany emphasized that the criticized Yi-Ko branches are legally and economically independent and that the criticized practices "represent a violation of our corporate values". They have "no tolerance or acceptance of actions that undermine the trust of our guests and the reputation we have built."

The Office for Consumer Protection Mönchengladbach reacted to the reporting, which also affected a restaurant in Mönchengladbach, by having the three branches in the city checked again by food inspectors. According to the head of the office, the branches are only checked regularly every 18 months, since system catering franchise companies would impose strict hygiene standards and therefore "experience" shows that there is a lower risk of violations of food law there than in smaller catering establishments. The Mönchengladbach branches had been checked without any objections within the last nine months. According to information from focus.de , the trade office in Munich also has the 11 branches of Yi-Ko Holding in the city “in its sights”. These have been checked 44 times in the past 16 months, "significantly more often than usual for the fast food industry". Since May 2, 2014, Burger King Beteiligungs GmbH has been carrying out "special inspections" by "teams" specializing in food safety in the affected branches in order to "resolve grievances and retrain every restaurant manager and employee". Six restaurants were then temporarily closed.

On November 24, 2014, RTL broadcast another undercover report. The conditions were again reported, such as expired food, re-labeled food, lack of occupational safety, violation of continued wages in the event of illness and undermining collective agreements. The report had already been shown ten days before the broadcast to the Burger King management in Munich, which then anticipated the television broadcast with the termination of the Yi-Ko Holding.
