The list of judges at the International Criminal Court contains all persons who were or are active as regularly elected judges at the International Criminal Court .

The International Criminal Court consists of 18 judges who are elected for a nine-year term. Of the judges who were elected in 2003 after the court was founded, a third were each elected for an initial term of three, six or nine years, in order to enable staggered re-election or re-election in the following period. This means that elections for one third of the judges take place every three years. The judges are elected by secret ballot by the contracting parties to the Rome Statute . Each State Party may nominate a candidate who does not need its nationals must have, but its one of the Parties in each case, national needs.

Candidates must enjoy a high moral standing, be impartial and honest, and meet the requirements for the highest judicial office in their state. The nominating state must explain in a declaration to what extent the candidate meets these requirements. In addition, each candidate must alternatively have proven specialist knowledge in the field of criminal law and criminal procedural law as well as relevant experience as a judge , prosecutor , attorney or in a similar capacity in criminal proceedings or demonstrable specialist knowledge in relevant areas of international law as well as extensive experience in a legal profession which is important for the judicial work of the Court of Justice. Depending on which requirements the candidate meets, he will be assigned to candidate list A or B; If the candidate fulfills both requirements, he can choose which list he would like to be allocated to. In the first election in 2003, at least nine judges were elected from List A and at least five from List B. Since then, the elections have to take place in such a way that the numerical ratio is maintained.

No two judges working at the court at the same time may come from the same country. The selection of judges should adequately represent the main legal systems of the world, as well as guarantee a fair geographical distribution and a balanced representation of female and male judges. Re-election is generally not permitted. An exception existed or still exists for judges who were only elected for a term of office of three years in 2003 and for those judges who were elected to a vacant seat and hold this office for the remaining term of the predecessor, provided that these were less than three years Years. Regardless of a possible expiry of the term of office, the judges of the main trial or appeal chamber remain in office until all main or legal remedies whose hearing before this chamber has already started have been concluded.

The judges exercise their office full-time. They are independent in the performance of their duties and are not allowed to engage in any activities that could affect their judicial duties or compromise confidence in their independence. If legitimate doubts can be raised about the impartiality of a judge, he will be excluded from the matter in question. If a judge commits serious misconduct or a serious violation of his official duties, or if he is unable to perform his duties, he will be removed from his office. The contracting states of the Rome Statute decide on removal from office in a secret ballot with a two-thirds majority. Disciplinary measures can be initiated for less serious misconduct.

Presidium and Chambers

The judges elect a president and a first and second vice-president with an absolute majority. Together they form the Presidium and exercise their office for a period of three years. A single re-election is permitted. The First Vice-President represents the President if he is prevented or expelled, the Second Vice-President represents the President if the First Vice-President cannot represent him. Among other things, the President and Vice-Presidents are responsible for the proper administration of the Court of Justice.

The Court consists of a Pre-Trial Division, a Main Trial Division and an Appeals Division to which the judges are assigned. The Pre-Trial Division and the Main Trial Division each consist of at least six judges, the Appeals Division consists of the President and four other judges. The judges are assigned to the individual departments according to their abilities. The judges are organized in chambers within the individual departments . While there is only one chamber in the appeals division, which includes all the judges in the division, several chambers can be formed in the other two divisions if necessary.

The Guyanese lawyer Mohamed Shahabuddeen was elected to the Court of Justice for a nine-year term in January 2009, but resigned for personal reasons before he took office.
