Role in nonsmoker protection

Frankenberger (2010)

From 1996 to 1998 the ÖDP had already carried out a successful referendum with the "Lean State without Senate" . Since 2007 Frankenberger has been campaigning for the ÖDP to initiate a referendum on the protection of non-smokers. When the Bavarian state government made up of the CSU and FDP, in office since 2008, introduced a relaxation of the smoking bans in restaurants, the ÖDP launched the popular initiative “For real non-smoker protection!” . After 13.9 percent of those eligible to vote had entered the support lists in the 14-day period at the end of 2009 (only 10% would have been necessary ) and the state parliament rejected the change in the law due to the referendum, there was a nationwide vote on July 4, 2010 Referendum in which 61% of the votes cast voted in favor of tightening the protection of non-smokers.

The Health Protection Act (GSG) of July 23, 2010 came into force on August 1, 2010.

In the following period Frankenberger was the target of numerous hostilities. He received death threats and he was also insulted as a “Nazi” in emails. In addition, he was insulted by hosts and guests when visiting restaurants and pubs or was banned from the house . In 2010 he was publicly “beheaded” at the “ Shift ” because of his activities prior to the 200th Munich Oktoberfest .

Frankenberger often appeared on talk shows calling for more direct democracy , including Hart aber fair , Maybrit Illner , Michel Friedman and Peter Hahne . Because of his commitment to the protection of non-smokers, he was proposed for the Bavarian Order of Merit and nominated for the 2010 Political Award.

In 2011, at an event organized by the ÖDP as part of the Political Ash Wednesday in a restaurant , Frankenberger was expelled from the restaurant by its owner. The event, at which Frankenberger was to speak, had to be relocated at short notice.

In Phoenix - political talk - show called him the ZDF - journalist Wolfgang Herles a "crazed young fascists ". Against the name Frankenberger has subsequently released a criminal penalty cease and desist obtains.
