CPVO

The Community Plant Variety Office ( CPVO , English C ommunity P lant V ariety O ffice ) than Variety Office an agency of the European Union with legal personality. The agency was established in implementation of Regulation (EC) No. 2100/94. It started work on April 27, 1995 ; Since December 6, 1996, it has been based in Angers , France .

The task of the Community Plant Variety Office is to regulate plant variety protection and to grant EU-wide industrial property rights for plant varieties.

Structure of the CPVO

Board of Directors

The Board of Directors consists of one representative from each member state and the European Commission and their deputies. The Board of Directors formulates the goals and the most important regulations, advises the CPVO and controls the measures of the Office and its President.

Leadership of the CPVO

The CPVO is presided over by a President appointed by the Council of the European Union . This draws up the budget and ensures that the tasks of the CPVO are implemented within the framework of the laws of the European Union . He is supported by a vice-president who represents him if he is unable to attend. In addition, the President of the CPVO delegates some of his duties to the Vice-President. Currently (March 2013) the CPVO is headed by Martin Ekvad as President and Carlos Godinho as Vice-President.

Internal organization

The CPVO consists of the Technical Department, the Finance and Administration Department and the Legal Department. In addition to these three main departments, there are two service groups of equal rank: Human Resources and IT Service.

Board of Appeal

The Board of Appeal receives complaints about technical decisions of the CPVO and rules on them. This chamber is presided over by a chairman and a deputy. The chairperson was the presiding judge at the Federal Patent Court Gabriele Winkler and is currently (October 2016) the Dutchman Paul van der Kooij. The chairperson and her deputy select further members for the current case according to a precisely defined procedure. The members of the Board of Appeal are independent, but their decisions can be appealed to the European Court of Justice in Luxembourg .

Various organs of the European Union have direct or indirect influence on the Community Plant Variety Office: the Council , the European Commission , the European Court of Auditors and the European Court of Justice .
