State election in Bavaria 1946
The election for the first Bavarian state parliament after the Second World War took place on December 1, 1946, the turnout was 75.7%. In this election, each voter only had one vote. At the same time, a referendum was held on the Bavarian constitution , which was approved with 70.6% of the votes.
To the starting position
Bavaria had been part of the American occupation zone since the end of the war in 1945 . The American military government had appointed Fritz Schäffer (CSU) as Prime Minister on May 28, 1945 . Four months later, they deposed him because, in their opinion, he was not acting consistently enough against former NSDAP party members in the public service, and appointed Wilhelm Hoegner (SPD) as Prime Minister. Hoegner took over the office of Justice Minister on October 18, 1945 , was chairman of the preparatory constitutional committee from March 8, 1946 to June 24, 1946, and was chairman of the SPD Bavaria on May 13, 1946 . On June 30, 1946, the election to the state assembly in Bavaria took place, with the CSU receiving 58.3% and the SPD 28.8% of the vote.
Result
It was a 10 -% - electoral threshold at the level of districts , so a party had in at least one of the districts ten percent of the valid votes reached to feed into the state parliament. Therefore the KPD did not get a seat in the state parliament. The CSU achieved an absolute majority in the state parliament and appointed Hans Ehard as the next prime minister. The CSU and SPD formed the Bavarian state government .

Referendum
At the same time as the state elections, a referendum was held in Bavaria on the adoption of the Bavarian state constitution ( constitutional referendum ). The constitution was passed by a majority of the voters.
