The murder case Li Yangjie ( Chinese  李洋 潔  /  李洋 洁 , Pinyin Lǐ Yángjié ; born on September 9, 1990 in Henan , China ; missing since May 11, 2016 ; found dead on May 13, 2016 in Dessau-Roßlau ) was a violent crime in Saxony-Anhalt . The sex murder attracted attention because the suspect was related to two officers of the investigating police apparatus - the accused's mother and stepfather both worked for the investigating police in Dessau - and was also the subject of media releases in China. He brought police officers into the focus of the allegations.

Li Yangjie, a Chinese woman who was 25 at the time of her murder, was in her fifth semester of architecture at the Anhalt University of Applied Sciences in Dessau . She had previously studied at the School of Civil Engineering at Henan University of Science and Technology in her homeland in the east China 's Henan Province . She was the daughter of a police officer.

The perpetrator, who has meanwhile been convicted, is Sebastian F. (born 1996) from Dessau, the only son of the Dessau police officer Ramona S. He was treated as a teenager in the Merseburg child psychiatry. He broke off training; at the time of the offense he was receiving ALG II . With Xenia I. (born 1997) he has two children, Xenia I. has another from another man. Xenia I. reported that Sebastian F. felt pleasure when he inflicted pain on his sexual partners.

Sequence of events

On Wednesday, May 11, 2016, Li first went shopping, then went home and left her flat-share house in Johannisstrasse in downtown Dessau-Roßlau at around 8:30 p.m. to go jogging.

There was an antique shop on Johannisstrasse that was under video surveillance. The footage shows how Xenia I. waves the student over to her, points to an apartment on the second floor and asks her to help. You can see Li Yangjie looking around doubtfully, but then going with him. According to the investigators' knowledge, Sebastian F. was waiting behind the front door and overwhelmed her. He dragged Li Yangjie to the first floor and raped the young woman "in every possible way" (Süddeutsche Zeitung). Xenia I. asked Li Yangjie with the help of the Google translator, among other things, whether she had sexually transmitted diseases, whether she lived alone or in a shared apartment and whether friends would call the police.

Splashes of blood from the victim were found on the walls of the empty apartment at a height of 3 meters. The coroner spoke of a "painful agony of several hours" of the victim.

Xenia I. went to her apartment above and put the children to bed. Sebastian F. threw the severely disfigured victim from a window of the apartment into a garbage can behind the house. After the crime, the defendant telephoned his mother, police officer Ramona S., 40 times and told her about the crime.

Missing person report

The next day after Li Yangjie's disappearance, the police received a missing person report . Hundreds of police officers in the city were looking for the student. Meanwhile, many Chinese had posted messages about the missing student online on social media . Local Chinese also turned to the Chinese Embassy in Berlin to ask for help for the missing student.

On Friday, May 13, 2016, the police concentrated on the search at the Anhaltisches Theater and in the Friedensplatz area . Finally, a naked female corpse was found in a bush in the Hausmannstrasse / Johannisstrasse area. The body had severe wounds on the head and face that made immediate identification impossible. There were traces of a sexual offense; the woman died of severe blows and kicks. Large areas of blood were found at the crime scene.

A call by the police on May 14 to search for eyewitnesses led to an initial clue the next day. On May 16, the forensic examination confirmed that the body was definitely that of the missing student Li and that there should be at least a trace of foreign DNA on the body. On May 19, 2016, the existence of foreign DNA traces was confirmed. The samples were passed on to the Federal Criminal Police Office for comparison ; no matches were found with the DNA data stored there.

Since it was not initially clear that the body had been thrown out of the window of an empty rear building, the police decided not to search the surrounding houses and apartments.

Investigation, suspicion of cover-up against police officers

On Monday, May 23, 2016, a young couple, Sebastian F. (20 years), the son of an officer of the Saxony-Anhalt East Police Department and stepson of the director of the Dessau-Roßlau Police Department , and his fiancée, Xenia I. (20 years), the police. The two stated that the DNA found on Li Yangjie's dead body came from them and that they met Li for consensual sex the night before her disappearance at the couple's apartment, just a few meters from the location is where Li Yangjie was found. They also claimed they did not leave home after meeting Li. However, these statements contradict the statements of witnesses that Li was seen elsewhere at the time of the alleged meeting with the couple.

While both denied any involvement in the crime, they were based on the results of a DNA analysis on suspicion of common murder in custody taken.

The mother of the accused, Ramona S., and her husband Jörg S. were suspected of having destroyed evidence. The mother, who works for the Saxony-Anhalt East Police Department, apparently worked voluntarily in the “Anhalt” investigative group formed for the case. The stepfather Jörg S. has been the head of the Dessau police station since November 2012 . At the same time, they particularly helped clear the couple's apartment on Saturday, May 21, 2016. They denied having entered the apartment themselves. A witness, herself a police officer, said she had seen how "the day after the student's body was discovered, the mother and stepfather carried several bags from the apartment of their son and his fiancée".

Li Yangjie's parents, as it became known on May 26, 2016, filed a complaint against the Chief Public Prosecutor Folker Bittmann, who had stated that he had “not the slightest hint of initial suspicion” that the stepfather and mother of the main suspect had obstructed the investigation. Architecture professor Rudolf Lückmann , who looked after the victim's family, raised serious allegations against the public prosecutor's office of spreading an obviously false representation of the perpetrator, although this version could not be true: “There is a complete lack of understanding that the public prosecutor's office was the obvious excuse of the accused published and speaks of consensual sexual intercourse before the act. ”However, the Ministry of Justice of Saxony-Anhalt saw no reason to call in a public prosecutor other than Dessau.

The Ministry of the Interior of Saxony-Anhalt transferred the investigation on May 26, 2016 from the Dessau police to the police in Halle (Saale) , Police Department Saxony-Anhalt South .

The opening of a garden restaurant by the suspect's mother and her husband, both on sick leave , on June 3, 2016 with a party just one day after the victim's funeral service was the reason for a ban on conducting official business (“compulsory leave”, Section 39 of the Civil Service Status Act , no suspension according to the disciplinary law of Saxony-Anhalt) from June 6, 2016 by Interior Minister Holger Stahlknecht to the department manager Jörg S.

On June 5, 2016, it became public that 40 other criminal proceedings had been pending against the accused, including arson, insult, damage to property and bodily harm. The mother of the accused is said to have interfered in investigations earlier, for example with the allegation of arson.

On June 8, 2016, Chief Public Prosecutor Klaus Tewes stated that the accusation of thwarting punishment was being investigated in the office against the suspect's parents, but that at that time there was “no actual evidence” that this fact was fulfilled. Jörg S. was initially transferred to the Police College in Aschersleben by the Minister of the Interior , but complained back to his previous position. The attorney general in Naumburg came to the conclusion that Jörg and Ramona S. had no influence on the investigation against their son.

In September 2016, the public prosecutor brought charges against Sebastian F. and Xenia I. on charges of jointly committed murder for the purpose of concealment and of rape . Sebastian F. is also charged with two other rape cases that became known in the course of the investigation.

Sebastian F. is in the Raßnitz juvenile prison . In September 2016, he was beaten by a fellow inmate in the common area of ​​the institution. Sex offenders are mostly detested in the "prison hierarchy" by other inmates. He verbally abused a judicial worker while in custody.

Procedure

The main proceedings against Sebastian F. and Xenia I. were opened on November 25, 2016 at the Dessau-Roßlau Regional Court . The victim's parents appear as joint plaintiffs . Because a lay judge had not been sworn in, the process had to be started again on the third day of the trial.

Sebastian F. denied having anything to do with the crime. In mid-March 2017, the autopsy results were discussed at the hearing.

The defendant's stepfather, the policeman Jörg S., read out a statement in court in which he deeply regretted Sebastian F.'s act, but also complained about what was happening to him. He is "persecuted" by the press and has doubts about the rule of law. The mother of the defendant Ramona S. was unable to be questioned. The court then questioned both the detective and the medical officer who had certified the mother's inability to interrogate.

On August 4, 2017, Sebastian F. was sentenced to life imprisonment for rape and murder by the Dessau-Roßlau regional court under adult criminal law. The court found that his guilt was particularly serious. Xenia I. received a youth sentence of five years and six months for sexual assault . In addition, both have to pay compensation totaling 60,000 euros. On September 3, 2018, the Federal Court of Justice rejected the appeal regarding the judgment against Sebastian F., which is now legally binding. The appeal against the judgment against Xenia I. was also rejected by the Federal Court of Justice on September 6, 2018, and the judgment is therefore also final.

Reactions

On Wednesday, May 18, 2016, 600 Chinese students and many others gathered at the seminar site to take part in a memorial rally. About 150 people, including many students, took part in a memorial run from the city park dedicated to the murdered Li.

Citizens donated 4,000 euros to Li Yangjie's family at the end of May 2016.

The parents hired a lawyer in early June 2016; they also expressed their confidence that the case would be solved.

In June 2016, friends set up candles, flowers and photos of the murdered people in the front garden of the “Friendship” garden bar.

In 2018 the documentary Tatort Dessau - The Yangjie Li case was shown on ZDF doku and was repeated in 2019. In April 2019, excerpts from a surveillance video were shown for the first time in the episode The Murder Case Yangjie Li of the MDR television program The Trail of the Perpetrators .
