The State Criminal Police Office Baden-Württemberg ( LKA BW ) is a department of the police enforcement service. It is based at Taubenheimstrasse 85 in Stuttgart- Bad Cannstatt . The President of the LKA is Ralf Michelfelder .

tasks

According to the ordinance of the Ministry of the Interior for the Implementation of the Police Act (DVOPolG), it has the following tasks:

  • technical management and supervision of the police fight against crime
  • Working towards cooperation between all police departments in the preventive fight against crime and criminal prosecution
  • Police central office for planning, setting up and operating information systems

It can issue technical instructions to the state police stations for the performance of its tasks. However, general instructions of a fundamental nature may only be given with the consent of the Ministry of the Interior.

In detail, the LKA should perform the following tasks (Section 11 DVOPolG):

  • Collecting and evaluating messages and documents for the preventive fight against criminal offenses and criminal prosecution and informing the police stations about the results of the evaluation and about connections between criminal offenses,
  • operate an information and communication network and integrate the police information and communication systems as well as other national data processing methods and applications into it,
  • decide on requests for information about personal data in the files kept by him, insofar as these are not only stored access-protected for the storing office,
  • decide on requests for the deletion, blocking or correction of personal data in the files it maintains, insofar as the request is also directed to information about personal data in the files it maintains, if these are not only stored with access protection for the storing location, or Data is available on the person concerned at the State Criminal Police Office or in the area of ​​responsibility of several regional councils and the Stuttgart police headquarters,
  • to conduct practical research in special areas of police crime control and to develop criminalistic methods,

  • Collect and evaluate news about missing and unknown dead persons,
  • to advise on means and measures to protect against criminal offenders,
  • advise the licensing and supervisory authorities responsible under the Atomic Energy Act as well as the operators of nuclear facilities and the carriers of nuclear fuels with regard to the necessary technical protective measures against disruptions and other influences by third parties,
  • Coordinate police cooperation in the fight against crime with foreign countries and handle mutual legal assistance with foreign countries for the police stations in the country, unless the direct business route between the police stations is permitted,
  • send the Federal Criminal Police Office the information and documents required to carry out its tasks,
  • control supraregional search measures,
  • coordinate the deployment of the mobile task force and the special task force of the police,
  • Set up a coordination office in the event of hostage-taking and kidnapping cases and, in coordination with the Ministry of the Interior, take action-supporting and accompanying measures for the responsible service,
  • Train the undercover agents, decide on their deployment and lead them,
  • Carry out and coordinate witness protection measures,
  • Collect, evaluate and control suspicious transaction reports on money laundering and carry out financial investigations until the locally or factually responsible department is identified.

Prosecution

The State Criminal Police Office is only authorized to prosecute a limited number of criminal offenses. In detail, it concerns the following acts:

  • Betrayal of peace
  • Treason
  • Endangering the democratic constitutional state
  • Treason
  • Endangering external security
  • Formation of terrorist groups and related acts
  • Counterfeiting of money and stamps, EC cards and EC forms, supra-local marketing of counterfeit money and the use of counterfeit EC cards, EC forms and credit cards
  • Crimes committed with nuclear energy or radioactive radiation
  • Crimes against the environment related to radioactive substances
  • Offenses under Section 40 of the Explosives Act
  • Criminal offenses under the War Weapons Control Act

In other cases, it may only investigate if it concerns offenses according to the Narcotics Act , the trade in weapons and ammunition or offenses of organized crime and these offenses are of special importance and cannot be effectively investigated by the actually responsible departments. In addition, investigations may be undertaken if the Interior Ministry orders it or the Federal Criminal Police Office requests an investigation and the Interior Ministry does not declare that another agency is responsible. Furthermore, the investigations may be undertaken if special technical means are required for securing evidence, special knowledge is required for the investigation, the criminal offenses have been committed in the area of ​​several police stations and a uniform investigation is to be carried out, the criminal offense was committed in connection with a criminal offense that has already been committed is being prosecuted by the LKA or a police station asks an investigation. The LKA also determines when an instruction is issued by the public prosecutor's office .

The State Criminal Police Office is divided into the administrative department, the public relations, prevention and quality management / controlling departments as well as seven departments (Central Services, Center for Information Technology of the Baden-Württemberg Police, Operations and Investigation Support, Investigation and Evaluation, State Security, Forensic Institute, Cybercrime / Digital tracks).
