The housing assistance of the Federal supports federal employees in the search for an apartment close to the place of employment . In principle, there is no legal entitlement to the provision of living space vis-à-vis the federal government.

General

The Federal Agency for Real Estate Tasks is entrusted with the task of providing housing for the federal government ( Section 2 (1) sentence 2 BImAG ). Around 45 employees (full-time equivalents) are entrusted with this task. They are responsible for the allocation of the available apartments to federal employees and the acquisition of additional occupancy rights to third-party apartments in order to meet the continuing high demand for apartments to accommodate federal employees and their families, especially in metropolitan areas . On August 1, 2017, around 65,000 apartments, 36,000 of which were federally owned, were available for housing welfare purposes. At the end of 2017, the vacancy rate was 6.43 percent.

In 2018, the cost of purchasing occupation rights was around 1000 to 1200 euros per apartment per year. The minimum duration of the occupancy rights is usually 15 years. Refurbishment and modernization measures are continuously being carried out in the federally owned residential properties with the aim of achieving the current standard of living.

Housing welfare is part of the employer's duty of care towards his civil servants and soldiers ( Section 31 (1) SG ; Section 78 (1) BBG ) in the context of the employment and loyalty relationship (reunification of families, improvement of living conditions). In addition, the principles of economic efficiency and thrift play a role (savings in separation allowances ). Last but not least, the aim is to enable, maintain or strengthen the functionality of the administration and other federal institutions by accommodating employees close to their place of work.

Authorized group of people

For authorized persons providing housing assistance includes in particular all persons of a title of the federal budget salaried ( civil servants , soldiers , judges ) or paid ( workers in the public service ) be and are in a permanent employment relationship. Temporary soldiers are also entitled, as well as employees of grant recipients, provided that more than half of the institution in question is funded by the federal government. In principle, support is only provided if the change of residence became necessary for business reasons due to a change of place of work.

Persons with a particularly high transfer rate are soldiers (especially officers ) and officials from the Foreign Service .

Building work for housing welfare purposes

The federal government owns 25,700 undeveloped plots of land with an area of ​​87,000 hectares nationwide. In the major cities of Berlin , Düsseldorf , Frankfurt am Main , Hamburg , Cologne , Munich and Stuttgart , he is the owner of 971 undeveloped parcels with a total area of ​​930 hectares. The federal government intends to independently build apartments for federal employees on around 200  properties . Housing assistance in the Foreign Service

The provision of housing for members of the foreign service is regulated in Section 27 of the Act on the Foreign Service . The civil servant posted abroad has to take up residence at the foreign place of employment; the employer can allow exceptions. The civil servant should be provided with adequate accommodation abroad, taking into account the number of people belonging to his household, the official duties of the civil servant and the local conditions. The proportion of the housing costs to be covered by him from his own resources should not exceed the average expenses for residential purposes in Germany. If there is no possibility for the civil servant at a place of employment to rent a suitable apartment under reasonable conditions within a reasonable period, a company apartment should be made available. A foreign service official can be instructed to move into an appropriate official residence abroad if the official and local conditions so require.

Housing assistance for members of the Bundeswehr

The housing welfare offices are set up in the local Bundeswehr service centers and. Particularly intensive support is provided, for example, for those returning from abroad, severely disabled people, members of the guest armed forces or in special emergencies. In the latter case, cooperation can take place with the social services of the Bundeswehr . Private landlords also report third-party apartments without occupancy rights to the housing welfare offices if they are interested in renting them to members of the armed forces (e.g. secure income, reliability).

The federal government has been providing housing services since the 1950s. In the past few decades he has used various funding measures to cover the need for living space. Depending on the respective funding instrument, the terms of the occupancy rights and the expenses for this differed greatly.

The term already existed at the beginning of the 20th century. At that time, this included measures to promote housing construction both by the state and by companies (e.g. company apartments or housing cooperatives, especially by railway administrations).

Federal loan housing

Apartments that have received low-interest federal loans are referred to as federal loan apartments . The loan is linked to a right of receipt with favorable rents. Loans and voucher rights generally have the same terms. It has been thirty years since 1970. If the minimum periods agreed in the loan contracts have expired, the loans can be redeemed early by the private property developer. This eliminates the right to occupancy and rent limits.

Housing allocation

The allocation of flats is part of the federal housing welfare, the purpose of which is to support employees who are not or only inadequately housed at the place of work with the provision of adequate family-friendly housing. The execution of the tasks regarding the allocation of apartments is entrusted to the housing allocation offices of the Federal Agency for Real Estate Tasks. As part of the allocation of apartments, apartments owned by the federal government and subject to federal occupation law are offered for rent.

Levels of urgency

Apartments are allocated according to the urgency levels: separation allowance recipient (A), recognized cases of hardship (B, e.g. apartment applicants who have no or insufficient apartment at the place of employment or its catchment area) other applicants (C). Bonn-Berlin and Berlin-Bonn removals are also given priority. Applicants who are classified as severely disabled are given priority within the urgency levels.

Recognized housing requirements

In principle, a living space requirement of one room is recognized for each family member who is to move into the new apartment. It is also possible to recognize a further requirement.

Procedure

A prerequisite for a possible supply of adequate family-friendly living space is the submission of the application / questionnaire for apartment applicants to the housing welfare office of the employment office . They take a position from the point of view of priority and urgency and make the decisions about the replacement proposals on their own responsibility, taking into account the general award principles. In addition to the confirmation that the applicants belong to the group of people subject to federal housing welfare, the "urgency level" and the "recognized housing requirement" are also specified.

The registration office selects the most urgent applicant from the recruitment proposals, for whose ranking the following criteria are decisive:

  • Bonn-Berlin or Berlin-Bonn movers;
  • Separation allowance recipients as well as cases of hardship;
  • Number of children belonging to family household;
  • Amount of income of the applicant and his family;
  • current living conditions and rent burden;
  • Length of waiting time;
  • other personal, social and official matters.

Rent amount

The applicant's income situation has no influence on the determination of the rent. The Federal Agency for Real Estate Tasks agrees the rents achievable on the market for its apartments, which regularly corresponds to the local comparative rent . According to the Federal Budget Code (BHO), she is obliged to let apartments only at the “full value”. The regulations of the rent limit apply in the areas in which they apply. Rent increases take place in accordance with the legal and rental contract provisions.

Additional Services

The brokerage of developed or undeveloped land for sale, condominiums and the granting of family home loans are further federal housing welfare services that do not belong to the area of ​​housing allocation. From 2012 to 2017, no developed or undeveloped land or condominiums were awarded. From 2013 to 2017, federal employees were granted a total of 29 family home loans with a total amount of around one million euros due to the special regulations for family home subsidies for moves based on the relocation decisions (FHR move).
