Instant and factual jurisdiction

The Schlitz District Court was the first instance responsible for most of the court cases within its jurisdiction.

history

prehistory

In the Landgraviate of Hesse-Darmstadt , the judicial system was reorganized in an executive order of December 9, 1803. The “Hofgericht Gießen” was set up as a court of second instance for the province of Upper Hesse . The Hofgericht was for normal civil litigation court of second instance for civil wonderful family law matters and criminal law , the first instance. The superior court of appeal in Darmstadt was superordinate .

The jurisdiction of the first instance was exercised until 1821 by the offices in which jurisdiction and administration were not yet separated. The offices were not all public either. In the County of Schlitz, the relevant sovereign rights lay with the Count of Schlitz .

Establishment

From 1820 there were administrative reforms in the Grand Duchy of Hesse. This included that jurisdiction and administration were also separated at the lower level . The offices were dissolved and the administrative tasks previously performed by them were transferred to district administrative districts and the tasks previously performed by them in the jurisdiction of the district courts. In County Schlitz - which was regarded by the state as an office - this happened without any change in local jurisdiction. In terms of administrative tasks, the office was replaced by the newly formed district of Schlitz . The newly established Schlitz Regional Court took over the jurisdiction.

Further development

However, the patrimonial rights and duties of the Count von Schlitz were still preserved. It was not until 1838 that it was "nationalized": On June 1, 1838, the count renounced the administrative and judicial sovereignty due to him in the county, with a few exceptions in the area of forest and hunting in his own forests.

The German Courts Constitution Act of 1879 led to a uniform judicial organization throughout the empire . The "Hofgericht Gießen" was renamed " Landgericht Gießen ", the previous regional courts were renamed "Amtsgerichte". The "District Court of Schlitz" has now become the "District Court of Schlitz".

The End

The Schlitz district court was "shut down" in 1943, operated as a branch of the Lauterbach district court from 1945 to 1968 and then dissolved.

Superior courts

Subordinate to the district court of Schlitz was initially the court court in Gießen, from 1879 the regional court of Gießen . Subsequently, these were initially the Darmstadt Higher Appeal Court and, after 1879, the Darmstadt Higher Regional Court .
