Lauterbach District Court

from Wikipedia, the free encyclopedia

The Lauterbach District Court ( Lauterbach Regional Court until 1879 ) was a court of ordinary jurisdiction that existed from 1821 to 2005 as a branch until 2012 and was based in Lauterbach (Hesse) .

Jurisdiction and jurisdiction

As a branch of the Alsfeld district court, the court in Lauterbach was responsible for the communities Freiensteinau , Grebenhain , Herbstein , Lauterbach, Lautertal (Vogelsberg) , Schlitz , Ulrichstein and Wartenberg in all court matters with the exception of court administrative, family, insolvency, commercial, Cooperative, partnership, lay judges and juvenile lay judges' court cases.

history

In the Landgraviate of Hesse-Darmstadt , the judicial system was reorganized in an executive order of December 9, 1803. The “Hofgericht Gießen” was set up as a court of second instance for the province of Upper Hesse . The jurisdiction of the first instance was carried out by the offices or the landlords . The court court was the second instance court for normal civil disputes, and the first instance for civil family law cases and criminal cases. The superior court of appeal in Darmstadt was superordinate .

With the founding of the Grand Duchy of Hesse in 1806, this function was retained, while the tasks of the first instance were transferred to the newly created regional courts in 1821 as part of the separation of jurisdiction and administration. “Lauterbach Regional Court” was therefore the name for the first instance court in Lauterbach from 1821 to 1879. In the territorial territories of the province of Upper Hesse there were still legal offices for court cases of second instance in Büdingen and Hungen , which were subordinate to the court. The German Courts Constitution Act of 1879 led to a uniform judicial organization throughout the empire . The "Hofgericht Gießen" has now been renamed the " Landgericht Gießen " ( Regional Court Gießen ) as the superior second instance in the province, while the first instance courts have been renamed the District Court.

district Court

As a result of the abolition of the administrative and judicial offices by the Grand Ducal Hessian Ordinance of July 14, 1821, the Lauterbach Regional Court was formed, which initially had the following components:

In 1828 the municipality of Landenhausen , which previously belonged to the Altenschlirf regional court, was assigned to the Lauterbach regional court. On October 1, 1850, Rebgeshain was spun off and added to the Ulrichstein district court . With effect from September 1, 1854, the places Dirlammen, Eichelhain, Eichenrod, Engelrod, Hörgenau, Hopfmannsfeld and Lanzenhain were separated from the Lauterbach regional court district and added to the Herbstein regional court district , whose seat was changed from Altenschlirf in the course of the reorganization of the judicial districts in the Upper Hesse province in 1853 Herbstein was to be relocated and its district was to be enlarged, both of which, however, could only be completed a year later.

District Court

On October 1, 1879, due to the Courts Constitution Act, it was renamed the Lauterbach District Court and assigned to the district of the newly established Gießen District Court . Furthermore, the current district court district received the municipalities of Dirlammen and Rudlos, which had previously belonged to the Herbstein Regional Court, and the municipality of Udenhausen , which had previously belonged to the Alsfeld Regional Court ; the district court district Lauterbach now consisted of Allmenrod, Angersbach, Blitzenrod, Dirlammen, Eisenbach, Frischborn, Heblos, Landenhausen, Lauterbach, Maar, Reuters, Rimlos, Rudlos, Sickendorf, Udenhausen, Wallenrod and Wernges. With effect from January 1, 1888, with Schadges and Stockhausen, two other places previously included in the Herbstein District Court were added to the AG Lauterbach.

On May 1, 1948, Udenhausen had to be returned to the Alsfeld district court. With effect from November 1, 1949, the Lauterbach district court was separated from the Gießen district court and assigned to the newly established district of Fulda . On July 1, 1957, the Herbstein and Schlitz district courts were finally - after they were already at the end of the Second World War - declared branches of the Lauterbach district court, thereby expanding its district

On July 1, 1968, the district of the Lauterbacher Court enlarged again to offer you the repealed Local Court Scots proper place field crutches , Kölzenhain , Meiches , Rebgeshain and Ulrich Stein . As a result of the regional reform in Hesse , on September 29, 1972, the districts of Reinhards incorporated into Freiensteinau from the district court of Schlüchtern and Weidenau (Freiensteinau) from the district court of Fulda and, on July 1, 1973, the districts of Bobenhausen II , Helpershain , Ober-Seibertenrod , Unter, which were incorporated into Ulrichstein -Seibertenrod and Wohnfeld separated from the Alsfeld District Court and all these villages added to the Lauterbach District Court.

On January 1, 2005, the Lauterbach District Court was repealed as a full court and became a branch of the Alsfeld District Court . On January 1, 2012, this branch was also closed.

Courthouse

The district court building has been at Königsberger Strasse 8 since 1962. While the building itself is relatively inconspicuous, the courtroom is a listed building because of three portrait-format murals by Ewald Christian Tergreve and their artistic value.
