Franz Fiedler (born March 17, 1944 in Vienna ) is an Austrian lawyer. From 1992 to 2004 he was President of the Court of Auditors , from 2003 to 2005 Chairman of the Austria Convention , and from 2006 to 2014 President of the Advisory Board of Transparency International Austria .

Life

Franz Fiedler graduated from the Bundesrealgymnasium in 1962. He then completed a law degree at the University of Vienna , which he completed with a doctorate in 1966. iur. finished. He did military service in 1968.

In 1966 Fiedler started his career as a legal intern in the court service. In 1971 he became a judge at the Tulln District Court and in 1972 deputy chairman of the Tulln Labor Court . In 1973 he was appointed public prosecutor in Vienna. He was assigned to the Vienna Public Prosecutor's Office and was subsequently head of a department for criminal matters - in particular white -collar crime . In addition, in 1976 he was entrusted with the agendas of judicial administration , service law and disciplinary matters. In 1979 he was appointed deputy head of the Vienna Public Prosecutor's Office.

In 1980 Fiedler switched to politics: He became secretary of the parliamentary club of the Austrian People's Party . Fiedler was also proposed by the ÖVP as Vice President of the Court of Auditors. He held this office from March 10, 1986 to June 30, 1992. In the subsequent period up to June 30, 2004, he himself was President of the Court of Auditors. Although Fiedler was viewed with suspicion by the other parties as a “man of the ÖVP” at the beginning of his presidency, he was able to develop his own, independent profile over the course of the twelve years.

Through this impartiality ascribed to him, Fiedler established himself as a candidate for the chairmanship of the Austria Convention, which was to completely reorganize the Austrian Federal Constitution . He held the office from March 30, 2003 until the dissolution of the Convention in January 2005. Since then, he has been available to the National Council as a consultant for the special committee that advises the results of the Austria Convention .

Fiedler did not receive a higher public function after the end of the Austria Convention. This may be due to the fact that Fiedler's public reputation and his independence from the ÖVP were so advanced in March 2004 that he publicly considered running for the federal presidency for a few weeks - also against the candidate Benita, who had already been designated by the ÖVP Ferrero-Waldner . During 2003, Fiedler was considered a candidate for the federal presidency by the ÖVP itself.

In 2005 Fiedler became Vice President of the Advisory Board of Transparency International in Austria and in 2006 its President. He resigned from this position in March 2014 on the occasion of his 70th birthday.

Fiedler is an honorary member of the K.Ö.HV Franco-Bavaria Vienna in the ÖCV . From 2005 to the beginning of October 2010, Franz Fiedler was President of the Austrian Association of Academics , which is also close to the ÖVP. In March 2010, the status of the Vienna Academic Association as a preliminary organization of the ÖVP was suspended and its state chairman, Josef Müller, was excluded from the ÖVP. The main reason for this was the demand for the prohibition law to be deleted without replacement in a letter from November 2009. Fiedler only distanced himself from the letter after a long period of hesitation, and for months saw no "need to seek a conversation with letter writer Müller."

BUWOG scandal

In his function as President of the Court of Auditors, Fiedler prepared the first five-page report on the sale of BUWOG in 2002 . On the basis of this examination, the BUWOG sale was carried out by the then Finance Minister Karl Heinz Grasser . The process is currently occupying the public prosecutor's office - a lawsuit against Grasser, his best man and lobbyist Walter Meischberger , the lobbyist Peter Hochegger and 14 other people is in the room.

Several criminal charges against Fiedler in connection with the BUWOG sale were rejected as unfounded by the public prosecutor. The reports were brought in by Lederbauer, a former employee of the audit office, who left the audit office in disagreement in 2000 (several years before the BUWOG sale).
