Josef Moser (born October 6, 1955 in Lienz , East Tyrol ) is an Austrian administrative lawyer and politician ( non-party ; formerly FPÖ ). From 2004 to 2016 he was President of the Austrian Court of Audit .

From December 18, 2017 to June 3, 2019, as Federal Minister for Constitution, Reforms, Deregulation and Justice by the Austrian People's Party (ÖVP) he was a nominated member of the Federal Government Kurz I and the provisional Federal Government Löger .

Life

Josef Moser grew up in Carinthia , attended the Theresian military high school in Wiener Neustadt and studied law at the University of Vienna from 1976 ( doctorate 1981). From 1981 to 1990 he was an official of the Financial Directorate for Carinthia. From 1985 he acted there as a deputy of the board (personnel and presidential department).

In 1991, the then Governor of Carinthia, Jörg Haider ( FPÖ ) , appointed him his office manager, Moser was deputy head of the governor's secretariat. Then he was director of the FPÖ parliamentary club until 2003 . As club director , Moser was involved in the organization of the Federal Government Schüssel I (ÖVP-FPÖ coalition). Set up by the Minister of Transport and Infrastructure Hubert Gorbach (FPÖ) for a top position in the rail sector, he became General Director of Eisenbahn-Hochleistungsstrecken AG (HL-AG). He was then designated as a board member of ÖBB-Holding AG , but decided against this position and in 2004 became President of the Austrian Court of Auditors as a candidate for the Federal Government Schüssel II (ÖVP-FPÖ) . From July 1, 2004 to January 31, 2005, he was also a member of the Austria Convention initiated by the federal government .

He is married to Daniela Moser, the President of the Federal Finance Court .

President of the Court of Auditors

In 2004, Moser was appointed President of the Court of Auditors and was thus also chairman of the International Organization of Supreme Audit Institutions (INTOSAI), the international umbrella organization of audit offices worldwide.

From the beginning of his tenure as President of the Court of Auditors, Moser has repeatedly called for reform measures in numerous areas of Austria's administration - education, health, care, subsidies, etc. - and stressed their necessity. In 2004, he called on the federal and state governments to implement structural reforms in view of the development of public budgets . In 2009 Moser represented the Court of Auditors in the “New Administration” working group set up by the Austrian Federal Government. In the course of this working group in cooperation with the WIFO , the IHS , the National Debt Committee and the KDZ, the ACA presented numerous expert and position papers for reform measures - including the “599 Recommendations” of the ACA, which met with broad media coverage. In 2014, with regard to the structural zero deficit aimed at by the government by 2016, Moser pointed out that this would only be possible if reform measures were implemented at the same time.

In connection with the budget structure of federal states and municipalities , Moser described the standardization of the accounting of all regional authorities in Austria as necessary. According to Moser, the arithmetic works of the federal states and municipalities do not reflect the true financial situation, since liabilities and outsourced companies are often not shown. Responsibility for expenditure, responsibility for tasks and responsibility for financing would have to be unbundled. This affects many areas of public administration, such as education and health.

With regard to the role and tasks of the Court of Audit, Moser pointed out in 2012 that it was increasingly entrusted with administrative tasks - for example in connection with the Political Parties Act and the Media Transparency Act. This is at the expense of public control; the Federal Audit Office would then have fewer and fewer resources available for auditing.

Moser was also the subject of reports on illegal party financing: Jörg Haider's chauffeur testified that in 1996 five million schillings , which came from the industrialist Herbert Turnauer , in a plastic bag (hence the name plastic bag affair ) to Moser in his capacity as the then FPÖ -Club director. According to the law, such a party donation should have been reported to the audit office, but this did not happen in this case. When asked about the allegations at the hearing for the position of director of the Court of Auditors, Moser pointed out that all related proceedings had been discontinued; he is "not a plastic bag carrier". Later, in an interview with the daily newspaper “ Der Standard ” in April 2010 , Moser replied to the question of whether allegations in this regard would still annoy him that they had to be seen as part of the political process. Evidence that there was covert party funding has not been disclosed to date (2013).

In 2013, under Moser's leadership, the ACA received the INTOSAI Jörg Kandutsch Prize . The jury's reasoning stated that the Court of Auditors had carried out its function as the General Secretariat of INTOSAI in an “outstanding manner”. Mention was made of promoting the strengthening of the organization, ensuring the exchange of knowledge among all INTOSAI members, playing a leading role in the implementation of the first INTOSAI Strategic Plan (2005–2010) and the Strategic Plan (2011–2016), and commitment to the Achieving the adoption of UN General Assembly resolution A / 66/209 on the independence of the audit offices.

October 2013 Moser met in his role as INTOSAI Secretary General of UN Secretary-General Ban Ki-moon together. In doing so, they agreed to intensify cooperation to strengthen transparency and accountability. Audit offices can contribute to this, as they make undesirable developments visible, ensure the accountability of those responsible and give concrete suggestions for improvement with their recommendations.

Moser's term of office as President of the Audit Office and Secretary General of INTOSAI ended on June 30, 2016. He said goodbye with a position paper containing 1007 recommendations to the Austrian Federal Government. During his time as President of the Court of Auditors, there were 1,094 own-initiative audits, 81 special audits and 1,175 reports with a total of 79,042 pages. On June 16, 2016, the National Council elected Margit Kraker , previously director of the Styrian State Audit Office from 2013, as his successor .

In October 2016, Moser succeeded Gabriele Zuna-Kratky as President of EcoAustria . In December 2017, he resigned from his position as Federal Minister.

Ministerial office

In the National Council election on October 15, 2017 , he ran for third place on the federal list of Sebastian Kurz - the new People's Party and entered the National Council on November 9, 2017. On December 18, 2017, he was appointed and sworn in as Federal Minister of Justice by Federal President Alexander Van der Bellen . The government then changed the responsibilities of some ministries, which is why Moser was formally sworn in again on January 8, this time as Federal Minister for the Constitution, Reforms, Deregulation and Justice .

In the course of the BVT affair , Moser had to defend himself against the accusation that the judiciary had not acted properly during the house search on the premises of the Federal Office for the Protection of the Constitution and Counter-Terrorism (BVT) on February 28, 2018.

With the swearing-in of the federal government Bierlein , he resigned from the federal government. On June 12, 2019, he returned as a member of the National Council. At the end of March 2020, he resigned from the National Council; Werner Saxinger took over his mandate after Martina Ess resigned .
