Eva Souhrada-Kirchmayer

Eva Souhrada-Kirchmayer (* 1960 ) is an Austrian lawyer and a graduate of the European Academy . She is a judge at the Federal Administrative Court and chair of the data protection supervisory authority of the European Space Agency .

Life

Eva Souhrada-Kirchmayer was born in Vienna. She studied law and media law at the University of Vienna and completed her training in 1982 with a doctorate in law. From 1979 to 1983 she was Werner Ogris' assistant and lecturer at the Institute for Austrian and European Legal History at this university and worked as a legal historian. From 1983 to 1991 she worked at the Federal Ministry for Science and Research in the department for university law. From 1991 she worked in the Federal Chancellery in the department for data protection law of the constitutional service (from 1995 as head of the office of the data protection authorities, from 2004 department head). In 2010 she became head of the office of the data protection commission and its executive member.

Eva Souhrada-Kirchmayer was a managing member of the Austrian data protection commission until the reorganization of this authority at the end of 2013 (as such, head of the data processing register and the authority for the register of master data ). The Data Protection Commission was the authority that had to make decisions on the implementation of the Austrian Data Protection Act. It was organized as an independent authority following the organizational changes following a ruling by the European Court of Justice . As a managing member, Ms. Souhrada-Kirchmayer was both a decision-maker (member of the Senate) and head of the business operations of this commission. In connection with this, Ms. Souhrada-Kirchmayer was a member of Austria in the Article 29 data protection group , an advisory body of the European Commission in data protection matters and various national and international working groups.

In the context of these activities, their statements were quoted several times in the media in the current data protection context and in lectures, e.g. B. for health telematics and chats, also in connection with Google Street View , the transfer of patient data for market research purposes to the company IMS Health , with Facebook , Twitter or Apple , on the 7th European Data Protection Day 2013 in connection with the transfer of data to the USA etc. It is quoted as saying “We must not forget that the main purpose of existing social networks is to generate advertising revenue. Use is not free, we pay with our data. ”In connection with the decision of the ECJ, she considered the independence of the data protection commission and its outsourcing from the administrative area of ​​the Austrian Federal Chancellery to be a logical consequence.

Ms. Souhrada-Kirchmayer was a member of the working group that was put together by the European Union to work on the PRISM project. Her name also appears in some documents made publicly available through Wikileaks. She supported the authors' initiative to uphold civil rights in the digital age .

The function at the Council of Europe has the task of monitoring the use of personal data (including employee data) in the business operations of the Council of Europe and pointing out any irregularities. It is based on the directive of the Secretary General of the Council of Europe of April 17, 1989.

Eva Souhrada-Kirchmayer was one of the members of the Tele Health Services Commission at the Federal Ministry of Health, the successor to the STRING Commission. She is a lecturer in various events on the subject of legal informatics .

Other functions were the chair of the data protection project group of the Council of Europe (CJ-PD), chair of the data protection council working group during Austria's EU presidency, deputy chair of the advisory committee based on the data protection convention of the Council of Europe ETS 108 (T-PD) and a representative of the Federal in the data protection council and various other groups, such as the advisory group according to Article 31 of the EU data protection directive.

She was also the data protection officer at the Council of Europe .

She is referred to as a "renowned data protection officer" in her field and counted among the "more prominent persons" or "prominent individuals".

In 2006 Eva Souhrada-Kirchmayer was awarded the Great Decoration of Honor for Services to the Republic of Austria. In 2017 she was honored with the professional title of " Professor ".

Eva Souhrada-Kirchmayer was appointed judge at the Federal Administrative Court in Vienna on January 1, 2014.
