The design of the flag of North Dakota is almost an exact copy of the unit banner worn by state troops in the Philippine-American War . It was adopted by the North Dakota Legislative Assembly on March 3, 1911, although the colors were not precisely determined at the time. Legislation in 1943 adapted the flag to the original troop banner displayed at the North Dakota Heritage Center in Bismarck .

The official ratio of the flag is 33:26, significantly shorter than other flags; nevertheless the flag is practically always produced and sold in a ratio of 5: 3.
