Isi Foighel

Isi Foighel (born December 21, 1927 in Chemnitz , Germany ; † September 12, 2007 in Copenhagen ) was a German-born Danish lawyer and politician from Det Conservative Folkeparti , who was Minister for Taxes from September 10, 1982 to September 10, 1987 and taxes (Skatte- og Afgiftsminister) and was a judge at the European Court of Human Rights (ECHR) from 1988 to 1998 .

Life

Origin, studies and lawyer

Foighel came from a German Jewish family and fled to Denmark with his mother Hania Foighel in 1932, where he first visited the Carolineskole and then the La Courvejens Skole in Copenhagen . During the Second World War , after the occupation of Denmark by the German Wehrmacht, he fled to Sweden and attended the Danish school in Gothenburg between 1943 and 1945 .

After the end of the war Foighel returned to Denmark and, after graduating from Statsgymnasiet Schneekloths Skole in 1946, began studying law at the University of Copenhagen , which he graduated as Candidatus juris (Cand. Juris) in 1952 after specializing in public law . After completing his studies, he became a lecturer in public law at the University of Copenhagen in 1952 and received the university's gold medal for his academic achievements in 1956.

After Foighel got his legal license in 1956 and then settled as an independent lawyer (Landsretssagfører) from 1957 to 1964 . During this time he completed his 1961 promotion to Doctor of Law (Dr. juris) with a dissertation to nationalize foreign property, in 1964 under the title Nationalisering af fremmed Ejendom was published.

University professor and chairman of the Danish Refugee Aid

In 1964 Foighel accepted a professorship for law at the University of Copenhagen and taught there until 1973. After that, he worked as a lawyer again for a year until 1974. During this time he dealt with numerous legal topics and worked as a legal advisor to various committees and commissions.

The main focus of his work was legal training, but also development aid, minority and refugee problems. His work in these areas was shaped by strong personal experiences as a Jewish refugee. The solution of legal questions was carried out through an exact analysis of the problems and a subsequent treatment with linguistic precision. In the 1960s he played a key role in the decision of the Danish government to allow the immigration of Jewish refugees from Poland and their reception in Denmark.

As chairman of the Danish Refugee Aid (Dansk flygtningehjælp) from 1965 to 1971 Foighel made a significant contribution to the work of this organization of volunteers in shaping Danish refugee policy and was thus one of the main people in charge of the practical implementation of refugee aid.

As a university lecturer, he also made a significant contribution to human rights in Denmark and was briefly director of the Institute for International Law and European Law (Institut for international Ret og Europaret) in 1967 and then a member of its Senate between 1968 and 1973.

In addition, Foighel was chairman of the Danish Jewish community (Det mosaiske Trossamfund) from 1972 to 1973 .

Commitment to the self-government of Greenland

As chairman of the Commission for Self-Government of Greenland (Kommissions om Hjemmestyre i Grønland) from 1975 to 1978, Foighel made an important contribution to the internal autonomy of this part of the Danish national territory and was also chairman of the Commission for Scientific Studies in Greenland from 1975 to 1991 ( Commissions for videnskabelige Undersøgelser i Grønland) . As a member of another minority, he had the necessary background to understand the areas of conflict between Denmark and Greenland.

During this activity he was able to gain the trust of politicians and administrative officials in Greenland, but also of the minorities in the Syddanmark region , in order to promote the idea of ​​self-government through his negotiation. In particular, he understood people's problems with self-government and stated on a radio broadcast in 1976:

"The Greenlanders want to affirm their own worth, and while each has its own immeasurable worth, it is important for people to realize that they are responsible for their own lives and not grow under the care of another person."

Minister, MP and judge at the ECHR

On September 10, 1982 Foighel, who held a professorship for tax law at the University of Copenhagen from 1980 to 1997, was appointed Minister for Taxes and Duties (Skatte- og Afgiftsminister) in his cabinet by Prime Minister Poul Schlueter and held this office for exactly five years long until September 10, 1987. His successor as Minister of Taxation was then Anders Fogh Rasmussen from Venstre . Foighel was the second minister, after Henry Grünbaum , to come from an immigrant family.

In the elections of January 10, 1987, he was elected as a candidate for Det Conservative Folkeparti as a member of the Folketing and belonged to this for a legislative period until September 8, 1987.

After Jørgen Gersing's death on June 8, 1988, he succeeded him as a judge at the European Court of Human Rights (ECHR) in Strasbourg and held that judge's office for ten years until October 31, 1998. His successor was subsequently on November 1 1998 Peer Lorenzen .

In addition to his work as a judge, Foighel was chairman of the supervisory board of Danmarks Radio (DR) from 1991 to 1995 . After completing his judicial post at the ECHR, he became a senior researcher at the Danish Center for Human Rights Affairs (Det danske center for menneskerettigheder) in 1998 . At the same time he acted between 1999 and 2004 as chairman of the supervisory board of the Arctic Institute (Det Arktisk Institut) in Copenhagen.

After his death, Foighel was buried in the Mosaisk Vestre Anbavelsesplads , a Jewish cemetery in Copenhagen .
