The early state elections in Lower Austria in 2018 took place on January 28, 2018. The ÖVP was able to defend its absolute majority of mandates with a slight loss of votes (with 29 instead of 30 out of 56 mandates), the SPÖ was the second strongest party to hold its (13) mandates, the FPÖ won, the Greens lost slightly, the Neos are for the first time represented in the state parliament.

Starting position

In the 2013 state elections , the Austrian People's Party (ÖVP) and its top candidate, then Governor Erwin Pröll , defended its absolute majority despite losses. The Social Democratic Party of Austria (SPÖ) fell to an all-time low with its top candidate Josef Leitner . The Stronach (FRANK) team , which started for the first time, immediately became the third strongest player. The Greens (GRÜNE) with Madeleine Petrovic gained slightly, the Freedom Party of Austria (FPÖ) with Barbara Rosenkranz lost slightly.

As a result, the ÖVP concluded a labor agreement with the SPÖ, whereby, due to the proportional representation system, the ÖVP is represented in the state government with 5 regional councils, the SPÖ with 2 regional councils and the Stronach team with a regional council. The FRANK regional council, however, has already left its party, but retains its position in the regional government as an independent.

The list of Peter Pilz represented in the National Council did not run in the state elections, contrary to earlier speculations and statements. For the first time since 1919, the KPÖ did not stand as a candidate in the state elections in Lower Austria.

On February 2, 2018, one day after the official final results had been announced, the Lower Austrian Greens announced that they would be examining an election challenge to the state election at the Constitutional Court (VfGH). Due to the new regulation of voting rights for people who have a second residence in Lower Austria, many people should not have been allowed to vote against, criticized state spokeswoman Helga Krismer . In addition, it is an "arbitrary decision" of the respective mayor in the communities whether he or she is allowed to vote. On February 27, 2018, state spokeswoman Krismer announced that she would continue to examine a contestation of the election. An expanded state committee will discuss this and make a decision. Any contestation of the election would still be introduced during the applicable period - Thursday, March 1, 2018. The State Committee of the Greens decided not to contest the election on February 28, 2018. However, the list “Wir für Niederösterreich” (WFNOE), which only ran in the Baden constituency, brought a complaint to the Constitutional Court (VfGH). However, this was rejected by the Constitutional Court on June 15, 2018. NEOS country spokeswoman Indra Collini said in an interview with ORF Niederösterreich on August 7, 2018 , that she was in favor of a reform of the electoral law before the next upcoming state elections in Lower Austria in 2023. She described the current regulation as a "chicane".

Preferential votes

Unlike in 2013 , the results of the parties were not reflected by the preferential vote results. FPÖ top candidate Udo Landbauer received more preferential votes than SPÖ top candidate Franz Schnabl, although his SPÖ was well ahead of the FPÖ. The top candidates of the two small parties, Greens and NEOS, Helga Krismer and Indra Collini, respectively, were both behind the ÖVP regional councilors (LH deputy) Stephan Pernkopf, Karl Wilfing and Ludwig Schleritzko.

Exceeding the upper limit for election campaign costs

In June 2020, the state's Independent Party Transparency Senate determined that the Lower Austrian ÖVP had exceeded the maximum allowable election campaign cost limit of six million euros by almost eleven percent and imposed a fine of 26,000 euros on the party.
