The death of Jonny K. is a criminal case that occurred in Berlin in October 2012 . The 20-year-old Jonny K. fell victim to a violent confrontation on the night of October 14, 2012 near Berlin's Alexanderplatz . The incident received widespread public attention and sparked a discussion about youth and foreigner crime in Germany.

Jonny K. (Jonny Deipabba) was born on April 7, 1992 in Khon Kaen , Thailand , the son of a Thai mother and a German father . He immigrated to Germany with his family and lived with them in Berlin. There Jonny K. attended a birthday party on the evening of October 13, 2012, which took place in a club in the base building complex of the Berlin TV tower next to Alexanderplatz . On the night of October 14, 2012, he and three friends left the party. The four young men between the ages of 20 and 29, each with a migrant background , were drunk. Between the television tower and the Rotes Rathaus there was an argument on Rathausstrasse ( ) - on the sidewalk in front of a restaurant in the Rathauspassagen - with another group of six young men, also from a migrant background, which led to a violent argument between Onur U. and a friend of Jonny K. led. In the course of this argument, Bilal K. and Melih Y. are said to have torn Jonny K., who wanted to help his friend, to the ground and then kicked his head several times, causing him to pass out. Jonny K. was resuscitated at the scene by the emergency doctor and taken to a Berlin clinic. He later fell into a coma and died the next day from a blood clot in his brain. World icon

Investigation procedure and process

A few days after the crime, two out of six alleged perpetrators, each with a Turkish migration background and some with dual citizenship , surrendered to the police, and a third suspect was caught. A fourth suspect surrendered to investigative authorities in December 2012. Three of them were detained . Two other suspects fled abroad after the crime.

At the beginning of March 2013, the public prosecutor brought charges against initially four suspects. The young men between the ages of 19 and 21 are accused of dangerous bodily harm , among other things . Two of them are charged with bodily harm resulting in death . According to the public prosecutor's office, charges of murder or manslaughter were not brought because forensic examinations and the other investigations had not confirmed the necessary killing intent.

According to media reports, the alleged main perpetrator Bilal K., who initially fled to Greece , surrendered to the German authorities in early March 2013. The Turkish police authorities issued their own arrest warrant against Onur U., who had fled to Turkey , and asked the German police authorities to inspect the investigation files. Chancellor Angela Merkel addressed the case of the beaten to death schoolboy Jonny K. at her meeting with Turkish Prime Minister Recep Tayyip Erdoğan on February 25, 2013 in Ankara, according to information from Spiegel . Merkel made it clear that she expected an active search for Turkey to find the suspect. Less than six months after the fatal beating attack, the Turkish judiciary began investigations against the main suspect Onur U. Shortly afterwards, in April 2013, after his return from Turkey to Germany, he turned himself in to the police at Berlin's Tegel Airport.

From May 13, 2013, all six suspects had to appear before the Berlin Regional Court . The verdicts were pronounced on August 15, 2013. Despite the targeted blows and kicks in the head, the court saw no intention to kill. A conviction for manslaughter or murder was therefore ruled out. The court explicitly rated the reporting in the press as mitigating the penalty. Even before the trial, she described the suspects as “murderers” and “killers”, even though there was no legal homicidal offense, but physical injury resulting in death. All six perpetrators were sentenced by the court to prison terms without parole for dangerous bodily harm, some under youth criminal law. The main culprit Onur U. was sentenced to four and a half years in prison for bodily harm resulting in death. The defense lawyers had applied for suspended sentences for the perpetrators. The defense lawyers petitioned the Federal Court of Justice for revision of all judgments . The convicted perpetrators between the ages of 19 and 25, with the exception of Onur U., were released against conditions because the judgments had not yet become final due to the appeal. Onur U., with three previous convictions, remained in custody.

Two other defendants, Bilal K. and Melih Y., were sentenced to two years and eight months in prison each. They also applied for a revision of the rulings, which the Federal Court of Justice rejected in 2014 as obviously unfounded. The judgments are thus final.

Reactions

The incident became known nationwide, initially "because of the brutality of the crime and the banality of the occasion", but also because of the political involvement in criminal prosecution and the nationality of the Turkish-German main suspect. As a reaction to the killing, the police presence in the area of ​​Berlin's Alexanderplatz and the adjoining spacious open space between the television tower , Marienkirche , Spandauer Strasse and the Rathauspassagen was increased. A “contact mobile” was permanently stationed on the weekends.

Several hundred people took part in the central funeral service, including Berlin's Governing Mayor Klaus Wowereit and Justice Senator Thomas Heilmann . The funeral ceremony was designed by Buddhist monks.

Tina K. , the victim's sister eight years older, has been committed to combating violence and preventing violence since his death . She kicked u. a. in the television talk shows Anne Will and Maybrit Illner and gave lectures in educational institutions on the subject of youth violence. She also founded the association I Am Jonny e. V. , who opposes any exclusion, especially among young people. For her commitment she received the Bambi Media Prize in 2012 and the Order of Merit of the State of Berlin in 2014 .

The temporary memorial , a pavilion at the crime scene, was replaced by a permanent one. The victim's sister wanted a kind of stumbling stone, a memorial plaque embedded in the pavement . On October 14, 2013, the first anniversary of Jonny K.'s death, his sister Tina and Klaus Wowereit unveiled a brass plate with Jonny's handprint. The ceremony was attended by family and friends, Senator for the Interior Frank Henkel and several hundred participants, including school colleagues, tourists and passers-by.

On April 7, 2013, the 21st birthday of Jonny K., the memorial concert I am Jonny - Voices for our brother was organized in the Admiralspalast in Berlin . Participants included Seeed , Kool Savas , Blumio , Elif , Blue Man Group , Andreas Bourani , Mic Donet , Glasperlenspiel , Ferdinand Rennie, Peter Freudenthaler , Saint Lu , Jocelyn B. Smith , Günter Lamprecht , Joachim Deutschland and B-Tight . Interior Senator Henkel was the patron of this event with around 1000 visitors.
